1 1 Section 1. Section 902.12, subsection 2, Code 1997, is
1 2 amended to read as follows:
1 3 2. Sexual abuse in the second or third degree in violation
1 4 of section 709.3 or 709.4.
1 5 EXPLANATION
1 6 This bill adds sexual abuse in the third degree to the list
1 7 of crimes for which an inmate must serve 100 percent of their
1 8 sentence less any of the limited amount of good conduct time
1 9 which may be granted to the inmate. Under section 903A.2,
1 10 inmates sentenced under section 902.12 may only receive
1 11 reductions in sentence for good behavior in an amount not to
1 12 exceed 15 percent of the sentence imposed – meaning that the
1 13 inmate must effectively serve at least 85 percent of the
1 14 sentence imposed.
1 15 Sexual abuse in the third degree is a class "C" felony.
1 16 Class "C" felons are to be confined for no more than 10 years
1 17 and may be sentenced to a fine of at least $500 but not more
1 18 than $10,000.
