1 1 Section 1. Section 455B.305A, Code 1997, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 11. After the effective date of this Act,
1 4 a city, county, or private agency shall not construct a new
1 5 sanitary landfill at a site which is within five miles of the
1 6 border of an adjoining county without the approval of the
1 7 board of supervisors of the adjoining county.
1 8 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 9 immediate importance, takes effect upon enactment.
1 10 EXPLANATION
1 11 This bill prohibits the construction of a new sanitary
1 12 landfill at a site which is within five miles of the border of
1 13 an adjoining county without the approval of the board of
1 14 supervisors of the adjoining county.
1 15 The bill provides an immediate effective date.
