1 1 Section 1. NEW SECTION. 123.146 SALE OF BEER KEGS
1 2 RESTRICTED.
1 3 1. A class "A" beer permittee or special class "A"
1 4 permittee shall not sell beer in a container which exceeds one
1 5 gallon capacity unless the purchaser is a person licensed or
1 6 permitted pursuant to this chapter to sell beer for
1 7 consumption on the premises.
1 8 2. A person shall not offer to sell or sell beer in a
1 9 container which exceeds one gallon capacity for consumption
1 10 off the licensed or permitted premises.
1 11 EXPLANATION
1 12 This bill prohibits the sale of beer in containers which
1 13 exceed one gallon capacity unless the purchaser is a liquor
1 14 control licensee or permittee who is authorized to sell beer
1 15 for consumption on the premises. The bill prohibits the offer
1 16 for sale or sale of beer in containers which exceed one gallon
1 17 capacity for consumption off the licensed or permitted
1 18 premises.
1 19 Violators are guilty of a serious misdemeanor for a first
1 20 or second conviction and an aggravated misdemeanor for a third
1 21 or subsequent conviction, as provided in Iowa Code sections
1 22 123.90 and 123.91.
