1 3 Sec. 2. Section 422.45, subsection 12A, Code Supplement
1 4 1997, is amended to read as follows:
1 5 12A. The gross receipts from the sale of foods purchased
1 6 with or eligible for purchase with coupons issued under the
1 7 federal Food Stamp Act of 1977, 7 U.S.C. } 2011, et seq.
1 8 EXPLANATION
1 9 Under present law there are two different exemptions from
1 10 the state sales and use taxes for the purchase of food for
1 11 human consumption. One exempts items purchased with food
1 12 coupons issued by the federal government. The other exempts
1 13 items that are eligible to be purchased with such food coupons
1 14 but excludes certain food items from being exempt. The bill
1 15 provides for only one exemption for the purchase of those food
1 16 items which are purchased with or are eligible to be purchased
1 17 with those food coupons.
