  1  1    Section 1.  Section 614.8, subsection 2, Code Supplement
  1  2 1997, is amended to read as follows:
  1  3    2.  Except as provided in section 614.1, subsection 9, and
  1  4 section 614.8A, the times limited for actions in this chapter,
  1  5 except those brought for penalties and forfeitures, are
  1  6 extended in favor of minors, so that they shall have one year
  1  7 from and after attainment of majority within which to commence
  1  8 an action.
  1  9    Sec. 2.  Section 614.8A, Code 1997, is amended to read as
  1 10 follows:
  1 11    614.8A  DAMAGES FOR CHILD SEXUAL ABUSE – TIME LIMITATION.
  1 12    An The times limited for actions in this chapter are
  1 13 extended to permit an action for damages for injury suffered
  1 14 as a result of sexual abuse which occurred when the injured
  1 15 person was a child, but not discovered until after the injured
  1 16 person is of the age of majority, shall to be brought within
  1 17 four years from at any time after the time of discovery by the
  1 18 injured party of both the injury and the causal relationship
  1 19 between the injury and the sexual abuse.  
  1 20                           EXPLANATION
  1 21    This bill eliminates current limitations on bringing an
  1 22 action for child sexual abuse for injuries suffered as a
  1 23 result of sexual abuse which occurred when the injured person
  1 24 was a child.  Currently, actions discovered after the person
  1 25 attains the age of majority must be brought by the injured
  1 26 party within four years from the time of discovery of both the
  1 27 injury and the causal relationship between the injury and the
  1 28 sexual abuse.
