PAG LIN 1 1 Section 1. Section 256.7, subsection 20, Code 1997, is 1 2 amended by striking the subsection. 1 3 Sec. 2. Section 279.35, Code 1997, is amended to read as 1 4 follows: 1 5 279.35 PUBLICATION OF PROCEEDINGS. 1 6 The proceedings of each regular, adjourned, or special 1 7 meeting of the board, including the schedule of bills allowed, 1 8 shall be published after the adjournment of the meeting in the 1 9 manner provided in this section and section 279.36, and the 1 10 publication of the schedule of the bills allowed shall include 1 11 a list of claims allowed, including salary claims for services 1 12 performed. The schedule of bills allowed may be published on 1 13 a once monthly basis in lieu of publication with the 1 14 proceedings of each meeting of the board. The list of claims 1 15 allowed shall include the name of the person or firm making 1 16 the claim, the purpose of the claim, and the amount of the 1 17 claim. The schedule of bills and claims for reimbursement of 1 18 tuition and fees to parents, guardians, legal or actual 1 19 custodians, or students, that result from any fee waiver 1 20 policy shall be considered personal information in accordance 1 21 with section 22.7, subsection 1. However, salaries paid to 1 22 individuals regularly employed by the district shall only be 1 23 published annually and the publication shall include the total 1 24 amount of the annual salary of each employee. The secretary 1 25 shall furnish a copy of the proceedings to be published within 1 26 two weeks following the adjournment of the meeting. 1 27 Sec. 3. Section 282.1A, subsection 1, Code 1997, is 1 28 amended to read as follows: 1 29 1. A board of directors of a public school district may, 1 30 subject to the approval of the department of education, 1 31 provide an extended school program for residents of the 1 32 district who are over the maximum school age established in 1 33 section 282.1, who do not possess a high school diploma or a 1 34 high school equivalency diploma under chapter 259A, and who 1 35 are currently enrolled in an education program in the 2 1 district. The educational program may be separate from or 2 2 integrated into the regular school program. Residents 2 3 attending the program shall be included in the district's 2 4 basic enrollment and shall attend on a tuition-free basis. A 2 5 district may also provide services to nonresidents under this 2 6 section, and those persons shall be chargedasufficient 2 7 tuitionfeeto cover the cost of the instruction received by 2 8 the person as provided in section 282.6. 2 9 Sec. 4. Section 282.6, Code 1997, is amended to read as 2 10 follows: 2 11 282.6 TUITION AND FEES. 2 12 1. Every school shall be free of tuition to all actual 2 13 residents between the ages of five and twenty-one years and to 2 14 resident honorably dischargedsoldiers, sailors, and marines2 15 military personnel, as many months after becoming twenty-one 2 16 years of age as they have spent in the military or naval 2 17 service of the United States before they became twenty-one, 2 18 provided, however,feestuition may be charged covering 2 19 instructional costs for a summer school ordriversdriver 2 20 education program. The board ofeducationdirectors of a 2 21 school district may, in a hardship case, exempt a student from 2 22 payment of the abovefeestuition. Every person, however, who 2 23shall attend anyattends a public school after graduation from 2 24 a four-year course in an approved high school or its 2 25 equivalent shall be chargedasufficient tuitionfeeto cover 2 26 the cost of the instruction received bysuchthe person. 2 27This section shall not apply to tuition authorized by2 28chapter 260C.2 29 2. The board of directors of a school district may charge 2 30 reasonable fees, not to exceed the costs, for the following: 2 31 a. Textbooks as defined in section 301.1. 2 32 b. Eye-protective devices required under section 280.10. 2 33 c. Ear-protective devices required under section 280.11. 2 34 d. Towel service, uniform or robe cleaning or rental, 2 35 graduation cap and gown rental, musical instrument rental, 3 1 parking permits, and padlock rental. 3 2 e. Costs associated with participation in school-sponsored 3 3 activity programs if student participation is not required. 3 4 f. Transportation for resident pupils attending public 3 5 school who are not entitled to transportation under section 3 6 285.1. 3 7 g. Admission for students and other persons to school- 3 8 sponsored activities if student attendance is not required. 3 9 h. School supplies, materials, and services that are not 3 10 essential to a student's participation in, and that are not 3 11 required as part of, the educational program under section 3 12 256.11. For purposes of this paragraph, "services" are 3 13 limited to child care, preschool programs, and internet or 3 14 other on-line computer services. 3 15 i. Materials essential to a student's participation in 3 16 music, visual arts, and vocational services areas that are 3 17 required as part of the educational program under section 3 18 256.11 for grades nine through twelve. 3 19 3. The board of directors of a school district shall adopt 3 20 a fee policy and a fee waiver policy. The board shall charge 3 21 only fees approved by the board and adopted in the fee policy. 3 22 The fee waiver policy adopted may provide for the waiver of 3 23 any fee, or any portion of a fee, permitted under this 3 24 section. The fee and fee waiver policies, and any subsequent 3 25 changes to the policies, adopted by the board shall be filed 3 26 with the department of education. The fee and fee waiver 3 27 policies, or adequate summaries of the policies, shall be 3 28 published in the school district's student handbook. 3 29 4. Items and materials resulting from a student's efforts 3 30 become the property of the student unless impractical or in 3 31 violation of state or federal law. 3 32 5. For purposes of this section, "resident" means a person 3 33 who is physically present in a district, whose residence has 3 34 not been established in another district by operation of law, 3 35 and who meets any of the following conditions: 4 11.a. Is in the district for the purpose of making a home 4 2 and not solely for school purposes. 4 32.b. Meets the definitional requirements of the term 4 4 "homeless individual" under 42 U.S.C. } 11302(a) and (c). 4 53.c. Lives in a residential correctional facility in the 4 6 district. 4 7 6. This section shall not apply to tuition or fees 4 8 authorized by chapters 260C and 261C. 4 9 Sec. 5. Section 301.1, unnumbered paragraph 2, Code 1997, 4 10 is amended to read as follows: 4 11 Textbooks adopted and purchased by a school district may, 4 12 and shall to the extent funds are appropriated by the general 4 13 assembly, be made available to pupils attending nonpublic 4 14 schools upon request of the pupil or the pupil's parent under 4 15 comparable terms as made available to pupils attending public 4 16 schools. As used in thisparagraphsection, "textbooks" means 4 17 books and loose-leaf or bound manuals, systems of reusable 4 18 instructional materials or combinations of books and 4 19 supplementary instructional materials which convey information 4 20 to the student or otherwise contribute to the learning 4 21 process, or electronic textbooks, including but not limited to 4 22 computer software, applications using computer-assisted 4 23 instruction, interactive videodisc, and other computer 4 24 courseware and magnetic media. 4 25 Sec. 6. INITIAL REPORTS. Initial fee and fee waiver 4 26 policies required under section 282.6, subsection 3, shall be 4 27 filed with the department of education by October 1, 1997. 4 28 Sec. 7. EFFECTIVE DATE. This Act, being deemed of 4 29 immediate importance, takes effect upon enactment. 4 30 EXPLANATION 4 31 This bill authorizes public school districts to charge a 4 32 reasonable fee to cover the district costs for certain 4 33 products or services supplied to students. 4 34 The bill also requires the board of directors of a school 4 35 district to establish a fee policy and a fee waiver policy. 5 1 The board can only charge fees it has approved and adopted in 5 2 its fee policy. The fee waiver policy adopted may waive any 5 3 fee, or portion of a fee, permitted under the bill. The 5 4 policies must be filed with the department of education and 5 5 published or summarized in the district's student handbook. 5 6 The schedule of bills and claims paid by school districts 5 7 for reimbursement of tuition and fees to parents, guardians, 5 8 legal or actual custodians, or students as a result of any fee 5 9 waiver policy shall be considered a confidential record, as 5 10 provided in the bill. 5 11 Items and materials resulting from a student's efforts are 5 12 the property of the student unless impractical or in violation 5 13 of state or federal law. 5 14 The bill takes effect upon enactment. 5 15 LSB 1316SZ 77 5 16 kh/sc/14
