  1  4 RELATING TO THE DEPARTMENT OF WORKFORCE DEVELOPMENT AND
  1  5    THE ENFORCEMENT OF EMPLOYMENT LAWS CONCERNING EMERGENCY 
  1  6    AND HAZARDOUS MATERIALS INVENTORIES, AMUSEMENT RIDES, 
  1  7    ASBESTOS AND EMPLOYMENT AGENCY LICENSES, WAGE ASSIGNMENTS, 
  1  8    AND BOXING AND WRESTLING.  
  1  9 
  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1 11 
  1 12    Section 1.  Section 30.7, subsection 5, Code 1997, is
  1 13 amended to read as follows:
  1 14    5.  The department of workforce development shall compile
  1 15 data or information from the emergency and hazardous chemical
  1 16 inventory forms required to be submitted to the commission
  1 17 under section 312 of the Emergency Planning and Community
  1 18 Right-to-know Act, 42 U.S.C. } 11022, by county, and shall
  1 19 make the compiled reports available, annually, to each county
  1 20 in the state by providing the report to at least one public
  1 21 library in the named county.
  1 22    Sec. 2.  Section 88A.11, subsection 3, Code 1997, is
  1 23 amended to read as follows:
  1 24    3.  The commissioner may exempt amusement devices from the
  1 25 provisions of this chapter that have self-contained wiring
  1 26 installed by the manufacturer, that are operated manually by
  1 27 the use of hands or feet, that operate on less than one
  1 28 hundred twenty volts of electrical power, and that are
  1 29 fixtures or appliances within or part of a structure subject
  1 30 to the building code of this state or any political
  1 31 subdivision of this state.
  1 32    Sec. 3.  Section 88B.6, subsection 2, paragraph a,
  1 33 subparagraph (3), Code 1997, is amended to read as follows:
  1 34    (3)  An asbestos management planner for a school or a
  1 35 public or commercial building.
  2  1    Sec. 4.  Section 95.2, unnumbered paragraph 1, Code 1997,
  2  2 is amended to read as follows:
  2  3    Application for a license shall be made in writing to the
  2  4 labor commissioner.  The application must contain the name of
  2  5 the applicant, and if the applicant is a firm, the names of
  2  6 the members, and if it is a corporation, the names of the
  2  7 officers; and the name, number, and address of the building
  2  8 and place where the employment agency is to be conducted.  The
  2  9 application must be accompanied by the affidavits of at least
  2 10 two reputable citizens of the state in no way connected with
  2 11 the applicant, certifying to the good moral character and
  2 12 reliability of the applicant, or, if a firm or corporation, of
  2 13 each of the members or officers, and that the applicant is a
  2 14 citizen of the United States, if a natural person; also a
  2 15 surety company bond in the sum of twenty thousand dollars when
  2 16 an employee is required to contribute to the payment of fees,
  2 17 to be approved by the labor commissioner and conditioned to
  2 18 pay any damages that may accrue to any person because of a
  2 19 wrongful act, or violation of law, on the part of the
  2 20 applicant in the conduct of the business.  The application
  2 21 must be accompanied by a schedule of fees to be charged for
  2 22 services rendered to patrons, which schedule shall not be
  2 23 changed during the term of license without consent being first
  2 24 given by the labor commissioner.
  2 25    Sec. 5.  Sections 90A.3 and 91A.13, Code 1997, are
  2 26 repealed.
