  1  1    Section 1.  NEW SECTION.  261.110  IOWA TRIBUTE TUITION
  1  2 GRANTS.
  1  3    1.  An Iowa tribute tuition grant may be awarded to a
  1  4 child, whether a resident of this state or not, of a public
  1  5 safety employee or volunteer killed in the line of duty.
  1  6    2.  Eligibility for a tuition grant under this section
  1  7 shall be determined upon application to the commission, whose
  1  8 decision is final, and admission of the applicant to a
  1  9 community college established under chapter 260C, an
  1 10 institution of higher learning under the control of the state
  1 11 board of regents, or an accredited private institution as
  1 12 defined in section 261.9.
  1 13    3.  Grants shall be awarded on an annual basis and shall be
  1 14 credited by the institution against the student's tuition at
  1 15 the beginning of each semester, trimester, or quarter, in
  1 16 equal installments, upon certification by the institution that
  1 17 the student is admitted and attending the institution.
  1 18    4.  An eligible full-time student may receive tribute
  1 19 tuition grants for not more than eight semesters of
  1 20 undergraduate study or the trimester or quarter equivalent.
  1 21 An eligible part-time student may receive tribute tuition
  1 22 grants for not more than sixteen semesters of undergraduate
  1 23 study or the trimester or quarter equivalent.  The grant
  1 24 amount is limited to an amount equal to the resident tuition
  1 25 rate of the institution to which the eligible student is
  1 26 admitted and attending, not to exceed an amount equal to the
  1 27 resident tuition rate established for institutions of higher
  1 28 learning under the control of the state board of regents.
  1 29 "Full-time student" means an individual who is enrolled at a
  1 30 community college, accredited private institution, or board of
  1 31 regents university for at least twelve semester hours or the
  1 32 trimester or quarter equivalent.  "Part-time student" means an
  1 33 individual who is enrolled at a community college, accredited
  1 34 private institution, or board of regents university in a
  1 35 course of study including at least three semester hours or the
  2  1 trimester or quarter equivalent of three semester hours.
  2  2    5.  When used in this section, "public safety employee or
  2  3 volunteer killed in the line of duty" means a person whose
  2  4 death occurred in the performance of any act which is within
  2  5 the scope of the lawful duty or authority of the person while
  2  6 paid or volunteering in any of the following capacities in
  2  7 this state:
  2  8    a.  A peace officer as defined in section 801.4.
  2  9    b.  A law enforcement officer as defined in section 80B.3.
  2 10    c.  A reserve peace officer as defined in section 80D.1A.
  2 11    d.  A fire fighter as defined in section 411.1.
  2 12    e.  A volunteer fire fighter as defined in section 85.61.
  2 13    f.  An airport fire fighter employed by the military
  2 14 division of the department of public defense.
  2 15    g.  An emergency medical care provider certified to
  2 16 function as provided in section 147A.8.
  2 17    6.  The college student aid commission shall adopt rules
  2 18 pursuant to chapter 17A to administer this section.
  2 19    7.  There is appropriated from the general fund of the
  2 20 state to the college student aid commission for each fiscal
  2 21 year an amount sufficient for the purpose of awarding of
  2 22 tribute tuition grants as provided in this section.
  2 23    Sec. 2.  APPLICABILITY DATE.  This Act applies to the death
  2 24 of a public safety employee or volunteer which occurs on or
  2 25 after July 1, 1997.  
  2 26                           EXPLANATION
  2 27    This bill provides for the awarding of an Iowa tribute
  2 28 tuition grant to a child, whether a resident of this state or
  2 29 not, of a public safety employee or volunteer killed in the
  2 30 line of duty on or after July 1, 1997.  The bill defines a
  2 31 "public safety employee or volunteer killed in the line of
  2 32 duty" as a person whose death occurred in the performance of
  2 33 any act which is within the scope of the lawful duty or
  2 34 authority of the person while paid or volunteering in any of
  2 35 the following capacities in this state:  a peace officer, a
  3  1 law enforcement officer, a reserve peace officer, a fire
  3  2 fighter, a volunteer fire fighter, an emergency medical care
  3  3 provider, or an airport fire fighter employed by the military
  3  4 division of the department of public defense.
  3  5    Grant eligibility is determined by the commission and upon
  3  6 admission to an accredited private college in this state, a
  3  7 community college, or institution of higher learning under the
  3  8 control of the state board of regents.  The grant amount is
  3  9 limited to the tuition charged at the institution of
  3 10 admission, not to exceed the resident in-state tuition rate
  3 11 established for institutions of higher learning under the
  3 12 control of the regents.  An eligible student may receive
  3 13 tuition grants for not more than eight semesters of
  3 14 undergraduate study or the trimester or quarter equivalent.
  3 15 An eligible part-time resident student may receive tuition
  3 16 grants for not more than 16 semesters of undergraduate study
  3 17 or the trimester or quarter equivalent.
  3 18    The bill provides for a standing unlimited appropriation
  3 19 from the general fund of the state to pay for the awarding of
  3 20 tribute tuition grants.
