  1  4 RELATING TO THE DESIGNATION OF CERTAIN CORRECTIONAL
  1  5    FACILITIES.
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 602.6201, subsection 3, paragraph b,
  1 10 Code 1997, is amended to read as follows:
  1 11    b.  All other judicial election districts are entitled to
  1 12 the number of judgeships equal to the average, rounded to the
  1 13 nearest whole number, of the following two quotients, each
  1 14 rounded to the nearest hundredth:
  1 15    (1)  The combined civil and criminal filings in the
  1 16 election district divided by four hundred fifty.
  1 17    (2)  The election district's population divided by forty
  1 18 thousand.
  1 19    However, the judicial election district in which the Iowa
  1 20 state penitentiary at Fort Madison is located is entitled to
  1 21 one additional judgeship.
  1 22    Sec. 2.  Section 904.102, subsection 2, Code 1997, is
  1 23 amended to read as follows:
  1 24    2.  Iowa Anamosa state men's reformatory penitentiary.
  1 25    Sec. 3.  Section 904.102, subsection 8, Code 1997, is
  1 26 amended to read as follows:
  1 27    8.  Correctional release Newton correctional facility.
  1 28    Sec. 4.  Section 904.102, Code 1997, is amended by adding
  1 29 the following new subsection:
  1 30    NEW SUBSECTION.  8A.  Fort Dodge correctional facility.
  1 31    Sec. 5.  Section 904.206, Code 1997, is amended by striking
  1 32 the section and inserting in lieu thereof the following:
  1 33    904.206  NEWTON CORRECTIONAL FACILITY.
  1 34    The correctional facility at Newton shall be utilized as a
  1 35 correctional facility.  The facility shall include minimum
  2  1 security facilities and violator facilities pursuant to
  2  2 section 904.207.
  2  3    Sec. 6.  Section 904.904, Code 1997, is amended to read as
  2  4 follows:
  2  5    904.904  HOUSING FACILITIES – HALFWAY HOUSES.
  2  6    Unless the inmate is transferred to the correctional
  2  7 release center, or returns after working hours to the
  2  8 institution under jurisdiction of the department of
  2  9 corrections, the department of corrections shall contract with
  2 10 a judicial district department of correctional services for
  2 11 the quartering and supervision of the inmate in local housing
  2 12 facilities.  The board of parole shall include as a specific
  2 13 term or condition in the work release plan of any inmate the
  2 14 place where the inmate is to be housed when not on the work
  2 15 assignment.  The board of parole shall not place an inmate on
  2 16 work release for longer than six months in any twelve-month
  2 17 period unless approval is given by a majority of the full
  2 18 board of parole.  Inmates may be temporarily released to the
  2 19 supervision of a responsible person to participate in family
  2 20 and selected community, religious, educational, social, civic,
  2 21 and recreational activities when it is determined that the
  2 22 participation will directly facilitate the release transition
  2 23 from institution to community.  The department of corrections
  2 24 shall provide a copy of the work release plan and a copy of
  2 25 any restitution plan of payment to the judicial district
  2 26 department of correctional services quartering and supervising
  2 27 the inmate.
