PAG LIN 1 1 SENATE FILE 362 1 2 1 3 AN ACT 1 4 ESTABLISHING A WILD ANIMAL DEPREDATION UNIT WITHIN THE 1 5 DEPARTMENT OF NATURAL RESOURCES, ALLOWING THE DISCHARGE 1 6 OF FIREARMS IN STATE PARKS FOR CERTAIN PURPOSES, PRO- 1 7 VIDING FOR THE ISSUANCE OF ADDITIONAL FREE DEER HUNTING 1 8 LICENSES, SUBJECTING VIOLATORS TO AN EXISTING PENALTY, 1 9 AND PROVIDING AN EFFECTIVE DATE. 1 10 1 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 12 1 13 Section 1. Section 461A.42, subsection 1, Code 1997, is 1 14 amended by striking the subsection and inserting in lieu 1 15 thereof the following: 1 16 1. The use of firearms, explosives, and weapons of all 1 17 kinds by a person is prohibited in all state parks and 1 18 preserves except under the following conditions: 1 19 a. A firearm or other weapon authorized for hunting may be 1 20 used in preserves or parts of preserves designated by the 1 21 state advisory board on preserves at the request of the 1 22 commission. 1 23 b. A person may use a bow and arrow with an attached bow 1 24 fishing reel and ninety-pound minimum line attached to the 1 25 arrow to take rough fish as provided by rule of the 1 26 commission. 1 27 c. The commission may establish, by rule, the state parks 1 28 or parts of state parks where firearms may be discharged 1 29 during special events, festivals and education programs, or a 1 30 special hunt to control animal populations. The rules 1 31 governing special hunts to control animal populations shall be 1 32 applied separately to each designated state park. 1 33 Sec. 2. NEW SECTION. 481C.1 WILD ANIMAL DEPREDATION 1 34 UNIT. 1 35 A wild animal depredation unit is established within the 2 1 fish and wildlife division of the department of natural 2 2 resources. The unit shall be comprised of two wild animal 2 3 depredation biologists. The biologists shall serve under the 2 4 director of the department of natural resources. 2 5 Sec. 3. NEW SECTION. 481C.2 DUTIES. 2 6 The director of the department of natural resources shall 2 7 enter into a memorandum of agreement with the United States 2 8 department of agriculture, animal damage control division. 2 9 The unit shall serve and act as the liaison to the department 2 10 for the producers in the state who suffer crop and nursery 2 11 damage due to wild animals. The department shall issue 2 12 depredation permits as necessary to reduce crop and nursery 2 13 damage due to wild animals. The criteria for issuing 2 14 depredation permits shall be established in administrative 2 15 rules in consultation with the farmer advisory committee 2 16 created in section 481A.10A. 2 17 Sec. 4. NEW SECTION. 481C.3 FUNDING. 2 18 Notwithstanding section 483A.30, the revenue from 2 19 nonresident deer and wild turkey hunting licenses shall first 2 20 be used to pay the salaries, support, and maintenance of the 2 21 wild animal depredation unit established pursuant to section 2 22 481C.1. The remaining revenue from nonresident deer and wild 2 23 turkey hunting licenses shall be used to meet the requirements 2 24 of section 483A.30. 2 25 Sec. 5. REPORT TO GENERAL ASSEMBLY, 1998. The department 2 26 of natural resources shall report, during January 1998, to the 2 27 chairpersons and ranking members of the house committee on 2 28 natural resources and the senate committee on natural 2 29 resources and environment the number of applications received 2 30 for depredation permits and the number of depredation permits 2 31 issued during the preceding calendar year pursuant to section 2 32 481C.2. 2 33 Sec. 6. Section 483A.24, subsection 2, Code 1997, is 2 34 amended by adding the following new paragraph: 2 35 NEW PARAGRAPH. d. If the commission establishes a deer 3 1 hunting season to occur in the first quarter of a calendar 3 2 year that is separate from a deer hunting season that 3 3 continues from the last quarter of the preceding calendar 3 4 year, each owner and each tenant of a farm unit located within 3 5 a zone where a deer hunting season is established, upon 3 6 application, shall be issued a free deer hunting license for 3 7 each of the two calendar quarters. Each license is valid only 3 8 for hunting on the farm unit of the owner and tenant. 3 9 Sec. 7. Section 483A.30, Code 1997, is repealed effective 3 10 December 31, 1999. 3 11 Sec. 8. EFFECTIVE DATE.
