1 1 Section 1. NEW SECTION. 314.28 BARRIERS REQUIRED AT
1 2 CONSTRUCTION SITES.
1 3 The department shall provide or require a contractor
1 4 performing highway maintenance or construction to provide a
1 5 barrier in the lane of a highway which is closed and
1 6 undergoing maintenance or construction. The barrier shall be
1 7 of sufficient size and weight to divert a motor vehicle from
1 8 the area under construction or maintenance. The distance
1 9 between the barrier and the end of the highway maintenance or
1 10 construction zone shall be clearly marked to indicate that
1 11 traffic is prohibited from entering the lane in which the
1 12 barrier is located.
1 13 EXPLANATION
1 14 This bill requires the state department of transportation
1 15 to utilize, and to require contractors to utilize, a barrier
1 16 in the lane of a highway which is closed and undergoing
1 17 maintenance or construction. The barrier must be capable of
1 18 diverting any motor vehicle from the area in which workers are
1 19 performing maintenance or construction.
