  1  1    Section 1.  Section 69.16A, Code 1997, is amended to read
  1  2 as follows:
  1  3    69.16A  GENDER BALANCE.
  1  4    All appointive boards, commissions, committees, and
  1  5 councils of the state or a political subdivision of the state,
  1  6 including a city, county, or school district, established by
  1  7 the Code if not otherwise provided by law shall be gender
  1  8 balanced.  No person shall be appointed or reappointed to any
  1  9 board, commission, committee, or council established by the
  1 10 Code if that appointment or reappointment would cause the
  1 11 number of members of the board, commission, committee, or
  1 12 council of one gender to be greater than one-half the
  1 13 membership of the board, commission, committee, or council
  1 14 plus one if the board, commission, committee, or council is
  1 15 composed of an odd number of members.  If the board,
  1 16 commission, committee, or council is composed of an even
  1 17 number of members, not more than one-half of the membership
  1 18 shall be of one gender.  If there are multiple appointing
  1 19 authorities for a board, commission, committee, or council,
  1 20 they shall consult each other to avoid a violation of this
  1 21 section.  This section shall not prohibit an individual from
  1 22 completing a term being served on June 30, 1987.  This section
  1 23 shall not prohibit an individual on a board, commission,
  1 24 committee, or council of a political subdivision from
  1 25 completing a term being served on June 30, 1997.  
  1 26                           EXPLANATION
  1 27    This bill provides that membership on a board, commission,
  1 28 committee, or council of a political subdivision established
  1 29 by the Code shall be gender balanced.  A political subdivision
  1 30 includes a city, county, or school district.  The bill
  1 31 provides that the gender balance requirements shall not
  1 32 prohibit an individual currently serving on a board,
  1 33 commission, committee, or council of a political subdivision
  1 34 on June 30, 1997, from completing their term.
