PAG LIN 1 1 Section 1. Section 56.5A, Code 1997, is amended to read as 1 2 follows: 1 3 56.5A CANDIDATE'S COMMITTEE. 1 4 1. Each candidate for state, county, city, or school 1 5 office shall organize one, and only one, candidate's committee 1 6 for a specific office sought when the candidate receives 1 7 contributions in excess of five hundred dollars in the 1 8 aggregate, makes expenditures in excess of five hundred 1 9 dollars in the aggregate, or incurs indebtedness in excess of 1 10 five hundred dollars in the aggregate in a calendar year. 1 11 2. A political committee shall not be established to 1 12 support or oppose only one candidate for office, except that a 1 13 political committee may be established to support or oppose 1 14 approval of a single judge standing for retention. 1 15 3. a. A candidate's committee shall accept contributions 1 16 from sources other than individuals who permanently reside 1 17 within the district represented by the office to which the 1 18 candidate presently seeks election, only to the extent that 1 19 the candidate's committee has received and deposited in the 1 20 candidate's campaign account, an equal or greater total of 1 21 contributions from individuals who permanently reside within 1 22 the district. 1 23 b. A candidate who accepts a contribution in violation of 1 24 this subsection shall be fined civilly in an amount equal to 1 25 ten times the amount by which the contribution exceeded the 1 26 permitted limit. The fine proceeds shall be deposited in the 1 27 Iowa election campaign fund created by section 56.19. 1 28 EXPLANATION 1 29 This bill amends Code chapter 56 to restrict a candidate's 1 30 committee in its acceptance of contributions from individuals 1 31 who reside outside the candidate's district. A candidate 1 32 could accept funds from such sources only up to the amount of 1 33 funds that the candidate has collected from individuals who 1 34 permanently reside within the candidate's district. The 1 35 penalty for violation of this prohibition would be a civil 2 1 fine equal to 10 times the amount accepted in excess of the 2 2 limitation. 2 3 LSB 1963XS 77 2 4 jls/sc/14.1
