  1  1    Section 1.  Section 299.1B, Code 1997, is amended to read
  1  2 as follows:
  1  3    299.1B  FAILURE TO ATTEND – LOSS OF DRIVER'S LICENSE.
  1  4    A person who does not possess a high school diploma or its
  1  5 equivalent, and does not attend a public school, an accredited
  1  6 nonpublic school, competent private instruction in accordance
  1  7 with the provisions of chapter 299A, an alternative school, or
  1  8 adult education classes, or who is not employed at least
  1  9 twenty hours per week shall not receive a motor vehicle
  1 10 operator's license until age eighteen.  A person under age
  1 11 eighteen who has been issued a motor vehicle operator's
  1 12 license, who does not possess a high school diploma or its
  1 13 equivalent, and who does not attend a public school, an
  1 14 accredited nonpublic school, competent private instruction in
  1 15 accordance with the provisions of chapter 299A, an alternative
  1 16 school, or adult education classes, shall surrender the
  1 17 license and be issued a temporary restricted license under
  1 18 section 321.215.
  1 19    Sec. 2.  Section 321.213B, Code 1997, is amended to read as
  1 20 follows:
  1 21    321.213B  SUSPENSION FOR FAILURE TO ATTEND.
  1 22    The department shall establish procedures by rule for
  1 23 suspending the license of a juvenile who is in violation of
  1 24 section 299.1B or issuing the juvenile a temporary restricted
  1 25 license under section 321.215 if the juvenile is employed at
  1 26 least twenty hours per week.
  1 27    Sec. 3.  Section 321.215, subsection 1, paragraph e,
  1 28 unnumbered paragraph 2, Code 1997, is amended to read as
  1 29 follows:
  1 30    However, a temporary restricted license shall not be issued
  1 31 to a person whose license is surrendered under section 299.1B,
  1 32 or revoked pursuant to a court order issued under section
  1 33 901.5, subsection 10, or under section 321.209, subsections 1
  1 34 through 5 or subsection 7, or to a juvenile whose license has
  1 35 been suspended or revoked pursuant to a dispositional order
  2  1 under section 232.52, subsection 2, paragraph "a", for a
  2  2 violation of chapter 124 or 453B, or section 126.3.  A
  2  3 temporary restricted license may be issued to a person whose
  2  4 license is revoked under section 321.209, subsection 6, only
  2  5 if the person has no previous drag racing convictions.  A
  2  6 person holding a temporary restricted license issued by the
  2  7 department under this section shall not operate a motor
  2  8 vehicle for pleasure.  
  2  9                           EXPLANATION
  2 10    This bill provides that a person who does not possess a
  2 11 high school diploma or its equivalent and who does not attend
  2 12 a public school, an accredited nonpublic school, competent
  2 13 private instruction, an alternative school, or adult education
  2 14 classes shall not be issued a driver's license until age 18,
  2 15 and if the person has already been issued a license, the
  2 16 person shall surrender the license.  The bill also prohibits
  2 17 the department of transportation from issuing a temporary
  2 18 restricted license to the person.
  2 19    Currently, the Code does not address the issue of who
  2 20 possesses a high school diploma or its equivalent, but says
  2 21 only that a person who does not attend a public school, an
  2 22 accredited nonpublic school, competent private instruction, an
  2 23 alternative school, adult education classes, or who is not
  2 24 employed at least 20 hours per week shall not receive a motor
  2 25 vehicle operator's license until age 18.
