PAG LIN 1 1 SENATE FILE 285 1 2 1 3 AN ACT 1 4 RELATING TO HOUSEHOLD HAZARDOUS MATERIALS AND RETAIL LABELING 1 5 REQUIREMENTS. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 455F.1, subsection 4, Code 1997, is 1 10 amended to read as follows: 1 11 4. "Household hazardous material" means a product used for 1 12 residential purposes and designated by rule of the department 1 13 of natural resources and may include any hazardous substance 1 14 as defined in section 455B.411, subsection 2; and any 1 15 hazardous waste as defined in section 455B.411, subsection 3; 1 16 and shall include but is not limited to the following 1 17 materials: motor oils, motor oil filters, gasoline and diesel 1 18 additives, degreasers, waxes, polishes, pure solvents,paints,1 19with the exception of latex-based paints,lacquers, thinners, 1 20 caustic household cleaners, spot and stain remover with 1 21 petroleum base,andpetroleum-based fertilizers, and paints 1 22 with the exception of latex-based paints. However, "household 1 23 hazardous material" does not include noncaustic household 1 24 cleaners, laundry detergents or soaps, dishwashing compounds, 1 25 chlorine bleach, personal care products, personal care soaps, 1 26 cosmetics, and medications. 1 27 Sec. 2. Section 455F.8B, subsection 2, Code 1997, is 1 28 amended by striking the subsection. 1 29 Sec. 3. Section 455F.9, Code 1997, is amended to read as 1 30 follows: 1 31 455F.9 EDUCATION PROGRAM. 1 32 In addition to the "Toxic Cleanup Days" program the 1 33 department shall implement a public information and education 1 34 program regarding the use and disposal of household hazardous 1 35 materials. The program shall provide appropriate information 2 1 concerning the reduction in use of the materials, including 2 2 the purchase of smaller quantities,andselection of 2 3 alternative products, and hazards associated with the use of 2 4 unregistered and unregulated alternative products. The 2 5 department shall cooperate with existing educational 2 6 institutions, the household product industry, distributors, 2 7 wholesalers, and retailers, and other agencies of government 2 8 and shall enlist the support of service organizations, 2 9 whenever possible, in promoting and conducting the programs in 2 10 order to effectuate the household hazardous materials policy 2 11 of the state. 2 12 Sec. 4.
