PAG LIN 1 1 Section 1. Section 261C.3, subsection 2, Code 1997, is 1 2 amended to read as follows: 1 3 2. "Eligible pupil" means a pupil classified by the board 1 4 of directors of a school district, by the state board of 1 5 regents for pupils of the school for the deaf and the Iowa 1 6 braille and sight saving school, or by the authorities in 1 7 charge of an accredited nonpublic school as a pupil who is 1 8 maintaining a grade point average in the median range or above 1 9 for courses completed at the school in which the pupil is 1 10 enrolled, and is either a ninth or tenth grade pupil who is 1 11 identified according to the school district's gifted and 1 12 talented criteria and procedures, pursuant to section 257.43, 1 13 as a gifted and talented child, or an eleventh or twelfth 1 14 grade pupil, during the period the pupil is participating in 1 15 the enrollment option provided under this chapter. A pupil 1 16 attending an accredited nonpublic school shall be counted as a 1 17 shared-time student in the school district in which the 1 18 nonpublic school of attendance is located for state foundation 1 19 aid purposes. 1 20 Sec. 2. Section 261C.8, unnumbered paragraph 1, Code 1997, 1 21 is amended to read as follows: 1 22 An eligible postsecondary institution that enrolls an 1 23 eligible pupil under this chapter shall not charge that pupil 1 24 for tuition, textbooks, materials, or fees directly related to 1 25 the course in which the pupil is enrolled except that the 1 26 pupil may be required to purchase equipment that becomes the 1 27 property of the pupil. However, if the pupil fails to 1 28 complete and receive credit for the course, or if the pupil's 1 29 grade upon completing the course is not in the median range or 1 30 above, the pupil is responsible for all costs directly related 1 31 to the course as provided in section 261C.6 and shall 1 32 reimburse the school district for its costs. If the pupil is 1 33 under eighteen years of age, the pupil's parent, guardian, or 1 34 custodian shall sign the student registration form indicating 1 35 that the parent, guardian, or custodian is responsible for all 2 1 costs directly related to the course,if the pupil fails to 2 2 complete and receive credit for the course or if the pupil's 2 3 grade upon completing the course is not in the median range or 2 4 above. 2 5 EXPLANATION 2 6 This bill requires that a pupil must be maintaining a grade 2 7 point average in the median range or above, in addition to 2 8 other requirements in the Code, in order to be defined as an 2 9 "eligible student" in the postsecondary enrollment options 2 10 chapter of the Iowa Code. In addition, if the pupil's grade 2 11 upon completing a course taken in accordance with the 2 12 postsecondary enrollment options chapter is not in the median 2 13 range or above, the pupil, or the pupil's parent, guardian, or 2 14 custodian, if the pupil is under 18 years of age, is 2 15 responsible for all costs directly related to the course. 2 16 LSB 2135XS 77 2 17 kh/cf/24
