PAG LIN 1 1 SENATE FILE 193 1 2 1 3 AN ACT 1 4 RELATING TO THE ELECTION OF TRUSTEES FOR SPECIAL LAND USE 1 5 DISTRICTS. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 303.49, subsections 2, 3, and 4, Code 1 10 1997, are amended to read as follows: 1 11 2. Following the initial special election, an annual 1 12 election shall be heldon the second Tuesday of each September1 13 at a single polling place within the district designated by 1 14 the county auditor for the purpose of electing a trustee to 1 15 replace a trustee whose term will expire. The board of 1 16 trustees, in consultation with the county auditor, shall 1 17 select the election date. The county auditor shall perform 1 18 all other acts with reference to the election and conduct it 1 19 in like manner, as nearly as may be, as provided in chapters 1 20 45 and 49. Each registered voter at the election may vote for 1 21 one person whom the voter desires as a trustee for each 1 22 expiring term. The term of office for each trustee elected 1 23 shall be three years. 1 24 3. Vacancies in the office of trustee of a land use 1 25 districtshallmay be filled by the remaining members of the 1 26 board of trustees for the period extending to thesecond1 27Tuesday in Septembernext annual election at which time the 1 28 registered voters of the district shall elect a new trustee to 1 29 fill the vacancy for the unexpired term. Expenses incurred in 1 30 carrying out the annual elections of trustees shall be paid 1 31 for by the land use district. 1 32 4. When the initial board of trustees is elected under 1 33 this section the trustees shall be ranked in the order of 1 34 votes received from highest to lowest. Any ties shall be 1 35 resolved by a random method. The last ranked trustee shall 2 1 receive an initial term expiring at the next annual election 2 2 for trusteesin September, the sixth and fifth ranked trustees 2 3 receive an initial term expiring one year later, the fourth 2 4 ranked trustee receives an initial term expiring two years 2 5 after that election, the third and second ranked trustees 2 6 receive initial terms expiring three years after that 2 7 election, and the first ranked trustee shall receive an 2 8 initial term expiring four years after that election. 2 9 2 10 2 11 2 12 MARY E.
