1 1 Section 1. NEW SECTION. 306C.13A LOCAL CONTROL IN
1 2 HISTORIC CITIES.
1 3 A city which has a majority of the buildings in the city
1 4 listed on the national register of historic buildings is
1 5 exempt from the provisions of this division of this chapter or
1 6 another chapter of the Code relating to the adoption of an
1 7 ordinance containing a city plan for the erection and
1 8 maintenance of advertising devices. The city may adopt its
1 9 own plan and in so doing shall consult with the department
1 10 during the development of the plan. The plan must comply with
1 11 the requirements of the federal Highway Beautification Act, 23
1 12 U.S.C. ch. 131.
1 13 Neither the state nor the department shall be liable for
1 14 damages resulting from the placement of advertising devices
1 15 pursuant to this section and not otherwise in compliance with
1 16 this chapter. However, the city shall assume the risks of any
1 17 damages caused by signs which do not comply with the manual on
1 18 uniform traffic-control devices adopted under section 321.252.
1 19 EXPLANATION
1 20 This bill authorizes a city which has a majority of its
1 21 buildings listed on the national register of historic
1 22 buildings to adopt its own plan for controlling the erection
1 23 and maintenance of advertising devices, which include signs,
1 24 billboards, and posters. The plan must comply with the
1 25 Highway Beautification Act, 23 U.S.C. ch. 131. The city must
1 26 consult with the department of transportation regarding the
1 27 plan but the state is not liable for any damages caused by
1 28 advertising devices which are erected and which are not in
1 29 compliance with department regulations. The city, however,
1 30 assumes the risk of damages caused by signs which do not
1 31 comply with the state department of transportation's manual on
1 32 uniform traffic-control devices.
