PAG LIN 1 1 Section 1. Section 724.2, Code 1997, is amended by adding 1 2 the following new subsections: 1 3 NEW SUBSECTION. 8. A resident of this state, who 1 4 possesses an offensive weapon which is a curio or relic 1 5 firearm under the federal Firearms Act, 18 U.S.C. ch. 44, 1 6 solely for use in the official functions of a historical 1 7 reenactment organization of which the person is a member, if 1 8 the offensive weapon has been permanently rendered unfit for 1 9 the firing of live ammunition. The offensive weapon may, 1 10 however, be adapted for the firing of blank ammunition. 1 11 NEW SUBSECTION. 9. A nonresident, who possesses an 1 12 offensive weapon which is a curio or relic firearm under the 1 13 federal Firearms Act, 18 U.S.C. ch. 44, solely for use in 1 14 official functions in this state of a historical reenactment 1 15 organization of which the person is a member, if the offensive 1 16 weapon is legally possessed by the person in the person's 1 17 state of residence and the offensive weapon is at all times 1 18 while in this state rendered incapable of firing live 1 19 ammunition. A nonresident who possesses an offensive weapon 1 20 under this subsection while in this state shall not have in 1 21 the person's possession live ammunition. The offensive weapon 1 22 may, however, be adapted for the firing of blank ammunition. 1 23 EXPLANATION 1 24 This bill creates two exceptions to the prohibition, found 1 25 in Code chapter 724, against possessing offensive weapons. 1 26 The first exception is for residents of the state, who may 1 27 possess an offensive weapon solely for use in official 1 28 functions of a historical reenactment society of which the 1 29 person is a member. The offensive weapon must be a curio or 1 30 relic firearm under the federal Firearms Act, 18 U.S.C. ch. 1 31 44, and must be rendered permanently incapable of firing live 1 32 ammunition, although the weapon may be permanently adapted for 1 33 the firing of blank ammunition. The second exception is for 1 34 nonresidents, who may possess an offensive weapon solely for 1 35 use in official functions in Iowa of a historical reenactment 2 1 society of which the nonresident is a member if the person 2 2 legally possesses the offensive weapon in the person's state 2 3 of residence. The weapon must be a curio or relic firearm 2 4 under the federal Firearms Act, 18 U.S.C. ch. 44, and must be 2 5 rendered incapable of firing live ammunition at all times 2 6 while in this state. In addition, the person possessing the 2 7 weapon shall not possess live ammunition for the weapon while 2 8 in this state with the offensive weapon.
