1 1 Section 1. Section 34A.6A, Code 1997, is amended to read
1 2 as follows:
1 3 34A.6A ALTERNATIVE SURCHARGE.
1 4 1. Notwithstanding section 34A.6, the board may request
1 5 imposition of a surcharge in an amount up to two dollars and
1 6 fifty cents per month on each telephone access line. The
1 7 board shall submit the question of the surcharge to voters in
1 8 the same manner as provided in section 34A.6. If approved,
1 9 the surcharge may be collected for a period of twenty-four
1 10 months unless the period is extended as provided in subsection
1 11 2. At the end of the twenty-four-month period, the rate of
1 12 the surcharge shall revert to one dollar per month, per access
1 13 line.
1 14 2. Notwithstanding the twenty-four-month limitation
1 15 imposed by the voters pursuant to subsection 1, at the end of
1 16 the initial period during which a surcharge of two dollars and
1 17 fifty cents per month per access line is imposed, the board,
1 18 upon a determination that insufficient funds are available to
1 19 the board to implement the E911 service plan, may extend the
1 20 period during which the two dollar and fifty cent surcharge is
1 21 to be imposed by a period of no more than twelve months. The
1 22 board shall only extend such period after conducting a public
1 23 hearing to allow for public comment on such action. At the
1 24 end of the additional period under this subsection, the rate
1 25 of the surcharge shall revert to one dollar per month, per
1 26 access line.
1 27 EXPLANATION
1 28 This bill provides for extension of the alternative
1 29 surcharge of $2.50 per month per access line for a period of
1 30 up to 12 months beyond the initial period during which the
1 31 alternative surcharge was imposed. The extension can only
1 32 occur after the E911 board conducts a public hearing to allow
1 33 for public comment on the extension. Currently, the board may
1 34 impose a surcharge of $1 per month per access line, with the
1 35 ability to impose the alternative surcharge of $2.50 per month
2 1 per access line for a period of up to 24 months after approval
2 2 by referendum in the proposed E911 service area.
