  1  1    Section 1.  Section 321.210, subsection 2, paragraph d,
  1  2 Code 1997, is amended to read as follows:
  1  3    d.  The first two speeding violations within any twelve-
  1  4 month period of ten miles per hour or less over the legal
  1  5 speed limit in speed zones having a legal speed limit between
  1  6 thirty-four equal to or greater than thirty-five miles per
  1  7 hour and fifty-six but not greater than sixty-five miles per
  1  8 hour.
  1  9    Sec. 2.  Section 516B.3, subsection 1, Code 1997, is
  1 10 amended to read as follows:
  1 11    1.  The commissioner shall require that insurance companies
  1 12 transacting business in this state not consider speeding
  1 13 violations occurring on or after July 1, 1986, but before May
  1 14 12, 1987, which are for speeding violations for ten miles per
  1 15 hour or less over the legal speed limit in speed zones that
  1 16 have a legal speed limit greater than thirty-five miles per
  1 17 hour or speeding violations occurring on or after May 12,
  1 18 1987, which are for speeding violations for ten miles per hour
  1 19 or less over the legal speed limit in speed zones that have a
  1 20 legal speed limit equal to or greater than thirty-five miles
  1 21 per hour but not greater than fifty-five sixty-five miles per
  1 22 hour for the purpose of establishing rates for motor vehicle
  1 23 insurance charged by the insurer and shall require that
  1 24 insurance companies not cancel or refuse to renew any such
  1 25 policy for such violations.  In any twelve-month period, this
  1 26 section applies only to the first two such violations which
  1 27 occur.  
  1 28                           EXPLANATION
  1 29    This bill increases from 55 to 65 miles per hour the speed
  1 30 limit in speed zones for which the first two speeding
  1 31 violations within a 12-month period are not to be counted by
  1 32 either the department of transportation for purposes of
  1 33 driver's license suspension or insurance companies in
  1 34 establishing automobile liability policy rates.  The bill
  1 35 strikes language which was only applicable in 1986 and 1987.
