1 1 Section 1. Section 400.17, Code 1997, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. A member of a bargaining unit
1 4 composed of fire department personnel of a city who is elected
1 5 or appointed as an officer of a statewide organization or
1 6 local association composed of fire department personnel shall
1 7 be granted leave by the city to perform duties required by the
1 8 organization or association without loss of pay or benefits
1 9 subject to the requirements of this paragraph. The member
1 10 shall not be required to make up hours for time spent
1 11 performing duties required by the organization or association.
1 12 The member shall be required to notify the city of the
1 13 member's election or appointment as an officer in such an
1 14 organization or association and to arrange for a time trade
1 15 with another qualified fire department member.
1 16 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 17 immediate importance, takes effect upon enactment.
1 18 EXPLANATION
1 19 This bill provides that a fire department member subject to
1 20 civil service shall be permitted to become an officer of a
1 21 statewide or local organization or association composed of
1 22 fire department personnel without loss of pay or benefits.
1 23 The bill requires the member to notify the city of the
1 24 member's election or appointment and to arrange with other
1 25 qualified fire department members to trade time to permit the
1 26 member to perform the duties of the member's office. The bill
1 27 prohibits a city from requiring the member to make up work
1 28 hours based on hours missed working for the organization or
1 29 association.
1 30 This bill takes effect upon enactment.
