1 1 Section 1. NEW SECTION. 473.18 OPTIONS PROGRAM FOR
1 2 RESIDENTIAL CUSTOMERS OF LIQUEFIED PETROLEUM GAS.
1 3 1. As used in this section, unless the context otherwise
1 4 requires:
1 5 a. "Dealer" means a person engaged in the ordinary course
1 6 of business of selling liquefied petroleum gas to a consumer
1 7 who uses the gas to provide an energy source to a residence.
1 8 b. "Liquefied petroleum gas" or "gas" means material used
1 9 for fuel composed of the following hydrocarbons or the
1 10 following mixture of hydrocarbons: propane, propylene, normal
1 11 butanes, isobutanes, or butylenes.
1 12 2. A dealer shall display and make available to
1 13 residential customers purchasing liquefied petroleum gas the
1 14 most current publication of an awareness guide provided by the
1 15 department that contains information relating to the purchase
1 16 of liquefied petroleum gas by residential customers, including
1 17 but not limited to options commonly offered by dealers to such
1 18 customers. The description of commonly offered options shall
1 19 include benefits of selecting extended payments plans,
1 20 purchasing gas during periods of low demand, and executing
1 21 contracts for the supply of gas at predetermined prices.
1 22 3. The department shall adopt rules under chapter 17A
1 23 requiring a dealer to provide to residential customers
1 24 purchasing liquefied petroleum gas an offer to purchase gas by
1 25 contract. The contract shall provide for the purchase of a
1 26 supply of gas during periods of high demand at a predetermined
1 27 price.
1 28 EXPLANATION
1 29 This bill creates new Code section 473.18 and provides that
1 30 a liquefied petroleum gas dealer must display and make
1 31 available to residential customers the most recent publication
1 32 of an awareness guide provided by the department of natural
1 33 resources which includes information regarding purchasing
1 34 options. The department is to adopt rules requiring a dealer
1 35 to provide a contract purchase option to residential
2 1 customers. The contract option must provide for the purchase
2 2 of liquefied petroleum gas during periods of high demand at a
2 3 predetermined price.
