1 1 Section 1. Section 476.1, subsection 1, Code 1997, is
1 2 amended to read as follows:
1 3 1. Furnishing liquefied petroleum gas, gas by piped
1 4 distribution system, or electricity to the public for
1 5 compensation. As used in this subsection, "liquefied
1 6 petroleum gas" means material used for fuel composed of the
1 7 following hydrocarbons or the following mixture of
1 8 hydrocarbons: propane, propylene, normal butanes, isobutanes,
1 9 or butylenes.
1 10 EXPLANATION
1 11 This bill provides that a person furnishing liquefied
1 12 petroleum gas to the public for compensation is a public
1 13 utility for purposes of chapter 476, therefore subjecting the
1 14 person to regulation by the utilities division of the
1 15 department of commerce. Special regulations for gas public
1 16 utilities having less than 2,000 customers are currently
1 17 provided under section 476.1C and would apply to liquefied
1 18 petroleum gas sales under the bill. Section 476.1C requires
1 19 notice to customers of proposed increased rates, charges,
1 20 schedules, or regulations. Customers have a right to petition
1 21 the utilities board, and the board is authorized to make a
1 22 determination of just and reasonable rates. A civil penalty
1 23 is made applicable to persons violating the provisions of the
1 24 bill.
