  1  1    Section 1.  PLAN FOR FUNDING OF MEDICAL ASSISTANCE SERVICES
  1  2 – CREATION OF RESTRUCTURING ADVISORY COMMITTEE – DEVELOPMENT
  1  3 OF PLAN.
  1  4    1.  If funds received from the federal government for
  1  5 funding of services provided under the medical assistance
  1  6 program are reduced relative to the prior federal fiscal year
  1  7 or are converted to block grant form, a medical assistance
  1  8 restructuring advisory committee shall be created.
  1  9    2.  The committee shall be composed of not more than
  1 10 twenty-five members, to be appointed by the governor.  The
  1 11 members appointed shall be representative of the state
  1 12 population and shall include service consumers and providers.
  1 13 A minimum of sixty percent of the committee membership shall
  1 14 be service consumers and citizen representatives.
  1 15    3.  Additionally, the committee shall include the following
  1 16 nonvoting members:
  1 17    a.  Two members of the senate appointed by the majority
  1 18 leader of the senate after consultation with the president of
  1 19 the senate and the minority leader of the senate.
  1 20    b.  Two members of the house of representatives appointed
  1 21 by the speaker of the house after consultation with the
  1 22 majority leader and the minority leader of the house.
  1 23    c.  The director of human services, or the director's
  1 24 designee.
  1 25    d.  The director of public health, or the director's
  1 26 designee.
  1 27    4.  Appointments shall comply with sections 69.16 and
  1 28 69.16A.  Vacancies shall be filled by the original appointing
  1 29 authority and in the manner of the original appointments.
  1 30    5.  Nonlegislative members of the committee shall receive
  1 31 actual expenses incurred while serving in their official
  1 32 capacity and may also be eligible to receive compensation as
  1 33 provided in section 7E.6.  Legislative members shall receive
  1 34 compensation pursuant to section 2.10.
  1 35    6.  The committee shall develop a plan for the provision of
  2  1 services provided under the medical assistance program based
  2  2 upon the federal funding received.  A plan proposal shall be
  2  3 submitted to the general assembly for action prior to
  2  4 implementation of the plan.
  2  5    7.  The department of human services shall provide
  2  6 administrative support to the advisory committee.
  2  7    Sec. 2.  STATE TAXATION REFORM – CONTINGENCY.  It is the
  2  8 intent of the general assembly that implementation of any
  2  9 state taxation reform or reduction in any year shall be
  2 10 contingent upon the enactment of federal legislation which
  2 11 provides for medical assistance funding for that year and
  2 12 shall reflect the impact of any reduction in federal funding
  2 13 to the state for the medical assistance program.  
  2 14                           EXPLANATION
  2 15    This bill provides for the creation of a medical assistance
  2 16 restructuring advisory committee upon enactment of federal
  2 17 legislation which reduces federal funding for medical
  2 18 assistance based upon the prior federal fiscal year or which
  2 19 provides for federal funding in the form of a block grant.
  2 20 The committee is composed of consumers and providers of
  2 21 services under the medical assistance program.  Additionally,
  2 22 members of the general assembly and the directors of human
  2 23 services and public health serve as nonvoting members.  The
  2 24 bill provides for compensation of the members and requires
  2 25 that a plan proposal be submitted to the general assembly
  2 26 prior to implementation of the plan.
  2 27    The bill declares that it is the intent of the general
  2 28 assembly that implementation of any state taxation reform or
  2 29 reduction is contingent upon the enactment of federal
  2 30 legislation which provides for medical assistance funding, in
  2 31 any year, and is to reflect the impact of any reduction in
  2 32 federal funding to the state for the medical assistance
  2 33 program.
