  1  1    Section 1.  Section 455B.392, subsection 1, Code 1997, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  e.  The reasonable costs incurred by the
  1  4 state as a result of responding to or at the scene of a
  1  5 hazardous condition caused by that person, whether or not
  1  6 cleanup of a hazardous substance occurs.  
  1  7                           EXPLANATION
  1  8    This bill provides that a person having control over a
  1  9 hazardous substance is strictly liable for costs incurred by
  1 10 the state in responding to a hazardous condition caused by
  1 11 that person, whether or not cleanup of a hazardous substance
  1 12 occurs.
