PAG LIN 1 1 SENATE CONCURRENT RESOLUTION NO. _____ 1 2 BY VILSACK, GRONSTAL, DEARDEN, FINK, HALVORSON, 1 3 FLYNN, BLACK of Jasper, CONNOLLY, HARPER, HORN, 1 4 JUDGE, KIBBIE, NEUHAUSER, PALMER, McCOY, GETTINGS, 1 5 FRAISE, and HANSEN 1 6 A Concurrent Resolution encouraging the federal 1 7 government to ease restrictions on the immediate 1 8 removal from the classroom of students behaving 1 9 violently or disruptively and requesting an 1 10 appropriation increase to assist in establishing 1 11 alternative education programs. 1 12 WHEREAS, teachers cannot perform their jobs 1 13 effectively and students' learning abilities are 1 14 impaired when other students chronically or severely 1 15 disrupt class, sometimes to the point of endangering 1 16 the health and safety of teachers and students; and 1 17 WHEREAS, federal laws and regulations seemingly 1 18 ignore the rights of the students who choose to attend 1 19 school, focus on their education, and learn in a civil 1 20 environment; and 1 21 WHEREAS, schools are exposed to lawsuits from 1 22 parents who fear for their children's safety in 1 23 classrooms where disruptive and possibly violent 1 24 behavior must be tolerated because of federal laws and 1 25 regulations; and 1 26 WHEREAS, changes resulting from the enactment of 1 27 the revised Individuals with Disabilities Education 1 28 Act (IDEA), Pub. L. No. 105-17, improve the plight of 1 29 students, teachers, and administrators who wish to 1 30 learn and work in a safe environment, but do not go 2 1 far enough; and 2 2 WHEREAS, students who exhibit violent or 2 3 chronically disruptive behavior need the special 2 4 attention an alternative education program can 2 5 provide; NOW THEREFORE, 2 6 BE IT RESOLVED BY THE SENATE, THE HOUSE OF 2 7 REPRESENTATIVES CONCURRING, That the federal executive 2 8 branch and Congress are encouraged and requested to 2 9 ease the restrictions on the immediate removal from 2 10 the classroom of students behaving violently or 2 11 disruptively; and 2 12 BE IT FURTHER RESOLVED, That the federal 2 13 administration and Congress are also encouraged and 2 14 requested to increase IDEA appropriations to assist 2 15 states in establishing alternative education programs 2 16 for violent students; and 2 17 BE IT FURTHER RESOLVED, That upon passage by both 2 18 the Senate and the House of Representatives, that 2 19 copies of this resolution be delivered to the 2 20 President of the United States, the members of Iowa's 2 21 congressional delegation, and United States Secretary 2 22 of Education Richard W.
