1 1 Amend the House amendment, S-5400, to Senate File
1 2 2366, as amended, passed, and reprinted by the Senate,
1 3 as follows:
1 4 #1. Page 24, by inserting after line 25 the
1 5 following:
1 6 "Sec. . NEW SECTION. 297A.1 SCHOOL
1 7 INFRASTRUCTURE FUND APPROPRIATION.
1 8 1. There is appropriated from the general fund of
1 9 the state to the department of education for the
1 10 fiscal year beginning July 1, 1998, and ending June
1 11 30, 1999, the sum of one hundred million dollars to
1 12 establish, maintain, and administer a school
1 13 infrastructure fund.
1 14 2. Moneys appropriated in subsection 1 shall be
1 15 allocated to school districts throughout the state on
1 16 a per pupil basis. The amount of moneys allocated to
1 17 school districts shall be in the proportion that the
1 18 basic enrollment of a district bears to the sum of the
1 19 basic enrollments of all school districts in the state
1 20 for the budget year.
1 21 3. The department of management shall allocate to
1 22 each school district the amount calculated pursuant to
1 23 subsection 2 in one payment on or about October 15,
1 24 based upon the actual enrollment certified to the
1 25 department of education for each school district and
1 26 forwarded to the department of management, taking into
1 27 consideration the relative budget and cash position of
1 28 the state resources. By October 1, prior to the
1 29 receipt of funds, school districts shall submit to the
1 30 department of education a school infrastructure
1 31 progress report. The report shall provide adequate
1 32 assurance that the school district has developed or is
1 33 developing a school infrastructure plan containing an
1 34 analysis of school district infrastructure needs,
1 35 priorities, and an estimated timetable for completion
1 36 of infrastructure projects or allocation of funds
1 37 previously received by the school district pursuant to
1 38 subsection 2.
1 39 4. Moneys received under this section shall not be
1 40 commingled with state aid payments made under section
1 41 257.16 to a school district, and shall be accounted
1 42 for by the school district separately from state aid
1 43 payments. Payments made to school districts pursuant
1 44 to this section are miscellaneous income for purposes
1 45 of chapter 257 or are considered encumbered. Each
1 46 school district shall maintain a separate listing
1 47 within its budget for payments received and
1 48 expenditures made pursuant to this section. Moneys
1 49 received under this section shall not be used for
1 50 payment of any collective bargaining agreement or
2 1 arbitrator's decision negotiated or awarded under
2 2 chapter 20.
2 3 5. For purposes of this chapter, a "school
2 4 district" shall mean a school district as defined in
2 5 section 257.2.
2 6 Sec. . NEW SECTION. 297A.2 SCHOOL
2 7 INFRASTRUCTURE EXPENDITURES.
2 8 1. School districts shall expend funds received
2 9 pursuant to section 297A.1 for school infrastructure
2 10 needs. For purposes of this chapter, "school
2 11 infrastructure" includes the following:
2 12 a. Activities for which a school district is
2 13 authorized to contract indebtedness and issue general
2 14 obligation bonds under section 296.1, except those
2 15 activities related to a teacher's or superintendent's
2 16 home or homes. These activities include the
2 17 construction, reconstruction, repair, purchasing, or
2 18 remodeling of schoolhouses, stadiums, gyms,
2 19 fieldhouses, and bus garages.
2 20 b. Procurement of school house construction sites
2 21 and the making of site improvements.
2 22 c. Payment or retirement of outstanding bonds
2 23 previously issued for school infrastructure purposes,
2 24 as defined in this subsection, if it is determined by
2 25 the department of education that the school district
2 26 has undertaken a serious effort to meet its school
2 27 infrastructure needs. In making this determination,
2 28 the department shall consider the relative size and
2 29 property tax base of the school district, and the
2 30 information provided to the department in the school
2 31 district's infrastructure progress report pursuant to
2 32 section 297A.1.
2 33 d. Maintenance of schoolhouses and school district
2 34 property.
2 35 e. School improvement technology programs pursuant
2 36 to chapter 295, utilized for a school district.
2 37 2. Funds received by a school district pursuant to
2 38 this chapter shall not be expended to add a full-time
2 39 equivalent position or otherwise increase staffing."
2 40 #2. By renumbering, relettering, and redesignating
2 41 as necessary.
