1 3 #1. Page 2, by inserting after line 23 the
1 4 following:
1 5 "Sec. 131. NEW SECTION. 422.12G INCOME TAX
1 6 CHECKOFF FOR HISTORICAL PURPOSES.
1 7 1. A person who files an individual or a joint
1 8 income tax return with the department of revenue and
1 9 finance under section 422.13 may designate one dollar
1 10 or more to be paid to the Iowa historical foundation
1 11 as established as a nonprofit entity. If the refund
1 12 due on the return or the payment remitted with the
1 13 return is insufficient to pay the amount designated by
1 14 the taxpayer to the Iowa historical foundation, the
1 15 amount designated shall be reduced to the remaining
1 16 amount of the refund or the remaining amount remitted
1 17 with the return. The designation of a contribution to
1 18 the Iowa historical foundation under this section is
1 19 irrevocable.
1 20 2. The director of revenue and finance shall draft
1 21 the income tax form to allow the designation of
1 22 contributions to the Iowa historical foundation on the
1 23 tax return. The department, on or before January 31,
1 24 shall transfer the total amount designated on the tax
1 25 form due in the preceding year to the Iowa historical
1 26 foundation.
1 27 3. Contributions received pursuant to this section
1 28 by the Iowa historical foundation shall be used by it
1 29 for preservation of historically important sites,
1 30 structures, and artifacts.
1 31 4. The department shall adopt rules to implement
1 32 this section. However, before a checkoff pursuant to
1 33 this section shall be permitted, all liabilities on
1 34 the books of the department of revenue and finance and
1 35 accounts identified as owing under section 421.17 and
1 36 the political contribution allowed under section 56.18
1 37 shall be satisfied.
1 38 5. The limitation on income tax return checkoffs
1 39 specified in section 422.12E does not apply to this
1 40 checkoff."
1 41 #2. Page 37, by inserting after line 9 the
1 42 following:
1 43 "___. Section 131 of this Act, establishing
1 44 section 422.12G, applies retroactively to January 1,
1 45 1998, for tax years beginning on or after that date."
