PAG LIN 1 1 Amend the amendment, S-5631, to House File 2533, as 1 2 amended, passed, and reprinted by the House, as 1 3 follows: 1 4 #1. Page 1, by inserting after line 18 the 1 5 following: 1 6 "# . Page 11, by inserting after line 1 the 1 7 following: 1 8 " . LIMITED ENGLISH PROFICIENT STUDENT 1 9 INSTRUCTION PROGRAM AID. 1 10 For community colleges with limited English 1 11 proficient student instruction program costs that the 1 12 department of education determines are high relative 1 13 to instruction program costs for other limited English 1 14 proficient student instruction programs in the state: 1 15 .................................................. $ 1,000,000 1 16 A community college with a limited English 1 17 proficient student instruction program may submit an 1 18 application to the department of education, on a form 1 19 developed by the department, for assistance pursuant 1 20 to this subsection by November 1 of the school year in 1 21 which the community college seeks assistance. In 1 22 distributing funds, the department shall consider the 1 23 size, diversity, and enrollment trends of the school 1 24 district, the relative economic wealth and property 1 25 tax base of the community college district in 1 26 comparison to other applying community college 1 27 districts, and the efforts the community college has 1 28 undertaken to develop and monitor limited English 1 29 proficient student assimilation into the community 1 30 college population. Preference shall be given to 1 31 community colleges that have a limited English 1 32 proficient student enrollment within the upper twenty- 1 33 five percent of all limited English proficient student 1 34 instruction program enrollments in the state's 1 35 community colleges, as determined by the department of 1 36 education. 1 37 Assistance payments shall be made to community 1 38 colleges in accordance with this subsection beginning 1 39 with a December 15 payment. Funds shall be expended 1 40 solely for purposes related to limited English 1 41 proficient student program instruction. 1 42 Notwithstanding section 8.33, the moneys appropriated 1 43 in this subsection that remain unencumbered and 1 44 unobligated at the close of the fiscal year shall not 1 45 revert to the general fund but shall remain available 1 46 for expenditure for the purposes designated during the 1 47 succeeding fiscal year."" 1 48 #2.
