  1  1    Amend the amendment, S-5543, to House File 2494, as
  1  2 amended, passed, and reprinted by the House, as
  1  3 follows:
  1  4    #1.  Page 6, by inserting before line 29, the
  1  5 following:
  1  6    "Sec. ___.  NEW SECTION.  331.304B  CONFINEMENT
  1  7 FEEDING OPERATIONS – SITING ORDINANCE.
  1  8    1.  As used in this section, unless the context
  1  9 otherwise requires:
  1 10    a.  "Animal feeding operation structure" means the
  1 11 same as defined in section 455B.161.
  1 12    b.  "Animal weight capacity" means the same as
  1 13 defined in section 455B.161.
  1 14    c.  "Confinement feeding operation" means the same
  1 15 as defined in section 455B.161.
  1 16    d.  "Small animal feeding operation" means the same
  1 17 as defined in section 455B.161.
  1 18    2.  a.  A county may adopt a confinement feeding
  1 19 operations siting ordinance pursuant to section
  1 20 331.302.  The purpose of the ordinance shall be to
  1 21 allow approval of the siting of a confinement feeding
  1 22 operation regardless of chapter 335.
  1 23    b.  The ordinance shall establish a confinement
  1 24 feeding operations siting commission which shall
  1 25 function as provided in this section.  The board shall
  1 26 appoint seven members to the commission who reside in
  1 27 the county, representing urban and rural interests.
  1 28 The ordinance shall authorize a county to review and
  1 29 approve or disapprove the site of the construction of
  1 30 a confinement feeding operation, including a related
  1 31 animal feeding operation structure, pursuant to a plan
  1 32 developed by the commission and adopted by the county
  1 33 board of supervisors.  The ordinance shall provide for
  1 34 methods and procedures required for submission of
  1 35 proposals, review of proposals, and approval of a
  1 36 site.
  1 37    c.  The plan adopted under this section shall
  1 38 provide for all of the following:
  1 39    (1)  Ensuring the preservation and availability of
  1 40 agricultural land reserved for confinement feeding
  1 41 operations, including for the construction of
  1 42 confinement feeding operations and related animal
  1 43 feeding operation structures.
  1 44    (2)  Encouraging efficient urban development
  1 45 patterns that do not burden agricultural land reserved
  1 46 under the plan for confinement feeding operations.
  1 47    (3)  Preserving and protecting natural resources,
  1 48 including water sources and fragile environmental
  1 49 locations.
  1 50    (4)  Lessening congestion and overcrowding of
  2  1 confinement feeding operations, especially near
  2  2 cities.
  2  3    d.  The confinement feeding operations siting
  2  4 commission shall review each proposal for the
  2  5 construction or expansion of a confinement feeding
  2  6 operation, and recommend to the county board of
  2  7 supervisors that the board approve or disapprove the
  2  8 proposal based on the plan provided under this
  2  9 section.  The commission shall make its recommendation
  2 10 to the board within forty-five days after the date the
  2 11 board receives a complete proposal.  The board shall
  2 12 approve or disapprove a proposal within forty-five
  2 13 days after the date that the board receives the
  2 14 commission's recommendation.
  2 15    3.  This section does not authorize a county board
  2 16 of supervisors to adopt an ordinance which applies to
  2 17 any of the following:
  2 18    a.  Standards or requirements relating to the
  2 19 design or construction of animal feeding operation
  2 20 structures, including requirements established under
  2 21 chapter 455B, including rules adopted by the
  2 22 department of natural resources under that chapter.
  2 23    b.  The siting of a small animal feeding
  2 24 operation."
