  1  1    Amend House File 2498, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 20, by inserting after line 11 the
  1  4 following:
  1  5    "6.  Of the full-time equivalent positions
  1  6 authorized pursuant to this section, 1.00 FTE shall be
  1  7 designated to administer the rebuild our cities and
  1  8 counties program established pursuant to section
  1  9 405A.11."
  1 10    #2.  Page 23, by inserting after line 16 the
  1 11 following:
  1 12    "Sec. ___.  NEW SECTION.  405A.11  REBUILD OUR
  1 13 CITIES AND COUNTIES PROGRAM.
  1 14    1.  A rebuild our cities and counties (ROCC) fund
  1 15 is created in the state treasury.  The director of
  1 16 revenue and finance shall credit the rebuild our
  1 17 cities and counties fund with the moneys appropriated
  1 18 to the fund as provided in this section.  For purposes
  1 19 of this section, "revenues generated by the sales tax"
  1 20 means the estimated revenue from the gross receipts
  1 21 taxed by the state pursuant to chapter 422, division
  1 22 IV, as estimated by the revenue estimating conference
  1 23 pursuant to section 8.22A in December preceding the
  1 24 fiscal year for which the appropriation provided for
  1 25 in this subsection shall be made.  The moneys credited
  1 26 to the ROCC fund shall be apportioned on a per capita
  1 27 basis with an equal share allocated to each person
  1 28 residing in the state.  The share of each person
  1 29 residing in a city shall be paid to the treasurer of
  1 30 that city.  The share allocated to each person
  1 31 residing outside the boundaries of a city shall be
  1 32 paid to the county treasurer.  The population of each
  1 33 city shall be determined by the latest federal census.
  1 34 The population of each county shall be determined by
  1 35 the last federal census excluding the persons residing
  1 36 within the boundaries of each city within the county.
  1 37 There is appropriated from the general fund of the
  1 38 state to the ROCC fund annually the following amounts
  1 39 for the designated fiscal years:
  1 40    a.  For the fiscal year beginning July 1, 1999, an
  1 41 amount equal to two percent of the revenues generated
  1 42 by the sales tax.
  1 43    b.  For subsequent fiscal years beginning with July
  1 44 1, 2000, the amount of appropriation shall increase an
  1 45 additional two percent of the revenues generated by
  1 46 the sales tax if the requirements of subsection 2 are
  1 47 met.  However, the amount appropriated for a fiscal
  1 48 year shall not exceed a total of ten percent of the
  1 49 revenues generated by the sales tax.
  1 50    2.  The additional two percent of revenues
  2  1 generated by the sales tax, as specified in subsection
  2  2 1, shall be appropriated in a fiscal year only if the
  2  3 December revenue estimate for the general fund of the
  2  4 state for the next succeeding fiscal year exceeds the
  2  5 revenue estimate for the general fund of the state for
  2  6 the previous fiscal year by at least four percent.
  2  7    3.  During the budgeting process for each city and
  2  8 county, the governing body of the city or county shall
  2  9 request public comment, at a public hearing, on the
  2 10 expenditure of the moneys received from the rebuild
  2 11 our cities and counties fund.  After public comment,
  2 12 the governing body shall specify the amount of funds
  2 13 which will be used for tax relief, including how the
  2 14 tax relief will be accomplished and the amount of
  2 15 funds which will be appropriated for specific
  2 16 programs."
