LIMITED ENGLISH PROFICIENT STUDENT 1 6 INSTRUCTION PROGRAM AID. 1 7 For community colleges with limited English 1 8 proficient student instruction program costs that the 1 9 department of education determines are high relative 1 10 to instruction program costs for other limited English 1 11 proficient student instruction programs in the state: 1 12 .................................................. $ 1,000,000 1 13 A community college with a limited English 1 14 proficient student instruction program may submit an 1 15 application to the department of education, on a form 1 16 developed by the department, for assistance pursuant 1 17 to this subsection by November 1 of the school year in 1 18 which the community college seeks assistance. In 1 19 distributing funds, the department shall consider the 1 20 size, diversity, and enrollment trends of the school 1 21 district, the relative economic wealth and property 1 22 tax base of the community college district in 1 23 comparison to other applying community college 1 24 districts, and the efforts the community college has 1 25 undertaken to develop and monitor limited English 1 26 proficient student assimilation into the community 1 27 college population. Preference shall be given to 1 28 community colleges that have a limited English 1 29 proficient student enrollment within the upper twenty- 1 30 five percent of all limited English proficient student 1 31 instruction program enrollments in the state's 1 32 community colleges, as determined by the department of 1 33 education. 1 34 Assistance payments shall be made to community 1 35 colleges in accordance with this subsection beginning 1 36 with a December 15 payment. Funds shall be expended 1 37 solely for purposes related to limited English 1 38 proficient student program instruction. 1 39 Notwithstanding section 8.33, the moneys appropriated 1 40 in this subsection that remain unencumbered and 1 41 unobligated at the close of the fiscal year shall not 1 42 revert to the general fund but shall remain available 1 43 for expenditure for the purposes designated during the 1 44 succeeding fiscal year." 1 45 #2.
