NEW SECTION. 905A.1 DEFINITIONS. 1 6 For the purposes of this chapter, unless the 1 7 context otherwise requires: 1 8 1. "Division" means the division of criminal and 1 9 juvenile justice planning of the department of human 1 10 rights. 1 11 2. "Government" means a community-based 1 12 correctional program as defined in section 905.1, or a 1 13 city, school district or accredited nonpublic school, 1 14 or county which expends funds for incarceration or 1 15 supervision of individuals charged with or convicted 1 16 of a felony, an aggravated misdemeanor, or a serious 1 17 misdemeanor, or for crime prevention activities. 1 18 3. "Judicial election district" means a judicial 1 19 election district described in section 602.6109. 1 20 Sec. ___. NEW SECTION. 905A.2 LOCAL CORRECTIONS 1 21 INFRASTRUCTURE GRANT PROGRAM. 1 22 1. A local corrections infrastructure grant 1 23 program is created in the division. The division 1 24 shall adopt rules pursuant to chapter 17A as necessary 1 25 to administer the program in accordance with this 1 26 chapter. The rules shall include but are not limited 1 27 to provisions for auditing of grant expenditures. 1 28 2. The division shall develop a request for 1 29 proposals for the grant program and assist judicial 1 30 election districts in developing proposals in response 1 31 to the request. The division shall not accept more 1 32 than one proposal from a judicial election district 1 33 for each of the grant groupings. For the fiscal year 1 34 beginning July 1, 1999, grants shall be awarded from 1 35 moneys appropriated for this purpose from the rebuild 1 36 Iowa infrastructure fund created in section 8.57 in 1 37 accordance with this chapter in the following two 1 38 groupings: 1 39 a. Twenty-five million dollars to one or more 1 40 governments or groups of governments in judicial 1 41 election districts, divided proportionately according 1 42 to the judicial election districts' relative 1 43 proportion of the state's general population. 1 44 b. Nine million dollars to one or more governments 1 45 or groups of governments representing judicial 1 46 election districts, awarded according to criteria 1 47 developed by the task force established pursuant to 1 48 section 905A.3 based upon the relative amount of 1 49 criminal activity in the judicial election district, 1 50 the innovative nature of the proposal submitted by the 2 1 government or group of governments, and the statewide 2 2 need for the project proposed to be developed. 2 3 3. A proposal for a grant under this section is 2 4 subject to all of the following conditions: 2 5 a. A judicial election district may combine with 2 6 one or more other judicial election districts in 2 7 developing a proposal or may propose a joint project 2 8 in separate proposals. 2 9 b. A proposal shall be for one or more 2 10 infrastructure or school-based crime prevention 2 11 projects or combination of projects relating to one or 2 12 more of the following purposes: 2 13 (1) A county jail. 2 14 (2) A regional or multicounty jail. 2 15 (3) A county juvenile detention or shelter care 2 16 home, including retirement of outstanding debt for 2 17 such a home. 2 18 (4) A regional or multicounty juvenile detention 2 19 or shelter care home. 2 20 (5) A community-based correctional program 2 21 facility. 2 22 (6) A school-based crime prevention program. 2 23 (7) A runaway assessment center. 2 24 c. Grant moneys under this chapter shall not be 2 25 used for purposes other than infrastructure. 2 26 d. The division may accept or reject a proposal in 2 27 whole or in part. 2 28 e. A proposal must address the need for the 2 29 proposed project, degree of urgency for the project, 2 30 location of the project, provisions for the 2 31 governments within the judicial election district to 2 32 access the project, and the performance measures to be 2 33 used to evaluate the project. 2 34 f. The submission date for proposals under 2 35 subsection 2, paragraph "a" shall be on or before 2 36 February 16, 1999, and the submission date for 2 37 proposals under subsection 2, paragraph "b" shall be 2 38 on or before April 17, 1999. However, for good cause 2 39 shown, the division may extend the submission date for 2 40 proposals under subsection 2, paragraph "a". It is 2 41 the intent of the general assembly that the grant 2 42 award process be complete by June 30, 1999, and awards 2 43 made in the fiscal year beginning July 1, 1999. 2 44 However, the division may delay final approval of a 2 45 grant proposal which is approved in part while full 2 46 approval of the proposal is pending. 2 47 4. The office of the attorney general, the 2 48 department of education, and the university of 2 49 northern Iowa's criminology program shall work with 2 50 the division in implementing a public planning process 3 1 to assist the governments in judicial election 3 2 districts in developing a proposal, developing 3 3 technical assistance materials for the grant program, 3 4 developing the request for proposals, developing 3 5 proposed scoring tools, and producing model 3 6 performance measures and other evaluation processes 3 7 for grant program projects. The public planning 3 8 process shall include but is not limited to public 3 9 meetings in each of the judicial election districts. 3 10 Sec. ___. NEW SECTION. 905A.3 TASK FORCE. 3 11 1. The division shall establish and convene a 3 12 local corrections infrastructure grant program task 3 13 force to assist the division in scoring and evaluating 3 14 grant proposals and other assistance deemed necessary 3 15 by the division. 3 16 2. The membership of the task force shall include 3 17 but is not limited to representatives of the 3 18 following: 3 19 a. County sheriffs. 3 20 b. Police chiefs. 3 21 c. Office of the attorney general. 3 22 d. District judges. 3 23 e. Juvenile court judges. 3 24 f. Probation officers. 3 25 g. Juvenile court officers. 3 26 h. County supervisors. 3 27 i. City council members. 3 28 j. Criminal and juvenile justice planning advisory 3 29 council. 3 30 k. Juvenile services providers. 3 31 l. Community-based correctional programs. 3 32 m. County attorneys. 3 33 n. The Iowa state police association. 3 34 o. Local school officials. 3 35 p. Other members deemed necessary by the division 3 36 or task force. 3 37 3. Members of the task force are eligible for 3 38 reimbursement of actual and necessary expenses 3 39 incurred in the performance of their official duties. 3 40 The task force shall elect a chairperson and other 3 41 officers deemed necessary by the task force." 3 42 #2.
