PAG LIN 1 1 Amend House File 2487, as amended, passed, and 1 2 reprinted by the House, as follows: 1 3 #1. Page 1, by striking lines 18 through 22 and 1 4 inserting the following: "subsection 10, paragraph 1 5 "a", for a first or second offense. If the violation 1 6 is committed by a person who is employed by a licensee 1 7 or permittee and the employee failed to exercise 1 8 reasonable care to ascertain whether the person in 1 9 violation is under legal age, the licensee or 1 10 permitteeand the individualshalleachalso be deemed 1 11 to have committed the violation and shalleachalso be 1 12 punished as provided in this subsection. A licensee 1 13 or permittee shall not be deemed to have committed the 1 14 violation, however, if the employee knew that the 1 15 person was under legal age. A person who violates 1 16 section 123.49, subsection 2, paragraph "h", and who 1 17 has been previously convicted twice of the same 1 18 offense commits a serious misdemeanor." 1 19 #2.
