PAG LIN 1 1 Amend the amendment, S-5335, to House File 2164, as 1 2 passed by House, as follows: 1 3 #1. Page 1, by inserting after line 20 the 1 4 following: 1 5 "Sec. . Section 15E.192, subsection 2, Code 1 6 Supplement 1997, is amended to read as follows: 1 7 2. A city with a population of twenty-four 1 8 thousand or more, or a county seat city with a total 1 9 population that exceeds forty percent of the 1 10 population of the county or county seat cities located 1 11 in the same county with a combined total population 1 12 that exceeds forty percent of the population of the 1 13 county, as shown by the 1990 certified federal census, 1 14 may create an economic development enterprise zone as 1 15 authorized in this division, subject to certification 1 16 by the department of economic development, by 1 17 designating one or more contiguous census tracts, as 1 18 determined in the most recent federal census, or 1 19 designating other geographic units approved by the 1 20 department of economic development for that purpose. 1 21 If there is an area in the city which meets the 1 22 requirements for eligibility for an urban or rural 1 23 enterprise community under Title XIII of the federal 1 24 Omnibus Budget Reconciliation Act of 1993, such area 1 25 shall be designated by the state an economic 1 26 development enterprise zone. The area meeting the 1 27 requirements for eligibility for an urban or rural 1 28 enterprise community shall not be included for the 1 29 purpose of determining the area limitation pursuant to 1 30 subsection 3. In creating an enterprise zone, a city 1 31 with a population of twenty-four thousand or more, or 1 32 a county seat city with a total population that 1 33 exceeds forty percent of the population of the county 1 34 or county seat cities located in the same county with 1 35 a combined total population that exceeds forty percent 1 36 of the population of the county, as shown by the 1990 1 37 certified federal census, may designate as part of the 1 38 area tracts or approved geographic units located in a 1 39 contiguous city if such tracts or approved geographic 1 40 units meet the criteria and the city agrees to being 1 41 included. The city may establish more than one 1 42 enterprise zone. Reference in this division to "city" 1 43 means a city with a population of twenty-four thousand 1 44 or more, or a county seat city with a total population 1 45 that exceeds forty percent of the population of the 1 46 county or county seat cities located in the same 1 47 county with a combined total population that exceeds 1 48 forty percent of the population of the county, as 1 49 shown by the 1990 certified federal census." 1 50 #2.
