  1  6 "state-owned" the following:  "or school".
  1  7    #4.  Page 4, line 34, by striking the figure
  1  8 "7,000,000" and inserting the following:
  1  9 "109,700,000".
  1 10    #5.  Page 4, by inserting after line 34 the
  1 11 following:
  1 12    "a.  Of the amount appropriated in this subsection
  1 13 $100,000,000 shall be appropriated for school
  1 14 infrastructure renovation and construction.
  1 15    b.  Moneys appropriated for school infrastructure
  1 16 shall be allocated throughout the state on a per pupil
  1 17 basis.  The amount of moneys allocated to school
  1 18 districts shall be in the proportion that the basic
  1 19 enrollment of a district bears to the sum of the basic
  1 20 enrollments of all school districts in the state for
  1 21 the budget year.
  1 22    c.  The department of management shall allocate to
  1 23 each school district the amount calculated pursuant to
  1 24 paragraph "b" in one payment on or about October 15
  1 25 annually, taking into consideration the relative
  1 26 budget and cash position of the state resources, based
  1 27 upon the actual enrollment certified to the department
  1 28 of education for each school district and forwarded to
  1 29 the department of management.  By October 1 annually,
  1 30 prior to the receipt of funds, school districts shall
  1 31 submit to the department of education a school
  1 32 infrastructure progress report.  The report shall
  1 33 provide adequate assurance that the school district
  1 34 has developed or is developing a school infrastructure
  1 35 plan containing an analysis of school district
  1 36 infrastructure needs, priorities, and an estimated
  1 37 timetable for completion of infrastructure projects or
  1 38 allocation of funds received by the school district
  1 39 pursuant to paragraph "b".
  1 40    d.  Moneys received under paragraph "b" shall not
  1 41 be commingled with state aid payments made under
  1 42 section 257.16 to a school district, shall be
  1 43 accounted for by the local school district separately
  1 44 from state aid payments, and shall be spent as
  1 45 provided in section 297A.1.  Payments made to school
  1 46 districts are miscellaneous income for purposes of
  1 47 chapter 257 or are considered encumbered.  Each local
  1 48 school district shall maintain a separate listing
  1 49 within its budget for payments received and
  1 50 expenditures made pursuant to paragraph "b".  Moneys
  2  1 received shall not be used for payment of any
  2  2 collective bargaining agreement or arbitrator's
  2  3 decision negotiated or awarded under chapter 20.
  2  4    e.  For purposes of paragraphs "a" through "d", a
  2  5 "school district" shall mean a school district as
  2  6 defined in section 257.2, subsection 11."

  2 14    #9.  Page 10, by inserting after line 23 the
  2 15 following:
  2 16    "Sec. ___.  Section 99D.17, Code 1997, is amended
  2 17 to read as follows:
  2 18    99D.17  USE OF FUNDS.
  2 19    Funds received pursuant to sections 99D.14 and
  2 20 99D.15 shall be deposited in the general fund of the
  2 21 state rebuild Iowa infrastructure fund and shall not
  2 22 be subject to the requirements of section 8.60.  These
  2 23 funds shall first be used to the extent appropriated
  2 24 by the general assembly.  The commission is subject to
  2 25 the budget requirements of chapter 8 and the
  2 26 applicable auditing requirements and procedures of
  2 27 chapter 11.
  2 28    Sec. ___.  Section 99F.11, subsection 4, Code 1997,
  2 29 is amended to read as follows:
  2 30    4.  The remaining amount of the adjusted gross
  2 31 receipts tax shall be credited to the general fund of
  2 32 the state rebuild Iowa infrastructure fund.
  2 33    Sec. ___.  NEW SECTION.  297A.1  SCHOOL
  2 34 INFRASTRUCTURE EXPENDITURES.
  2 35    1.  School districts shall expend funds received
  2 36 pursuant to appropriations made in this Act for school
  2 37 infrastructure needs.  For purposes of this chapter,
  2 38 "school infrastructure" includes the following:
  2 39    a.  Activities for which a school district is
  2 40 authorized to contract indebtedness and issue general
  2 41 obligation bonds under section 296.1, except those
  2 42 activities related to a teacher's or superintendent's
  2 43 home or homes.  These activities include the
  2 44 construction, reconstruction, repair, purchasing, or
  2 45 remodeling of schoolhouses, stadiums, gyms,
  2 46 fieldhouses, and bus garages.
  2 47    b.  Procurement of school house construction sites
  2 48 and the making of site improvements.
  2 49    c.  Payment or retirement of outstanding bonds
  2 50 previously issued for school infrastructure purposes,
  3  1 as defined in this subsection, if it is determined by
  3  2 the department of education that the school district
  3  3 has undertaken a serious effort to meet its school
  3  4 infrastructure needs.  In making this determination,
  3  5 the department shall consider the relative size and
  3  6 property tax base of the school district, and the
  3  7 information provided to the department in the school
  3  8 district's infrastructure progress report pursuant to
  3  9 section 297A.1.
  3 10    d.  Maintenance of schoolhouses and school district
  3 11 property.
  3 12    e.  School improvement technology programs pursuant
  3 13 to chapter 295, utilized for a school district.
  3 14    2.  Funds received by a school district pursuant to
  3 15 this chapter shall not be expended to add a full-time
  3 16 equivalent position or otherwise increase staffing."
  3 17    #10.  Title, by striking pages 1 through 3 and
  3 18 inserting the following:  "An Act making
  3 19 appropriations from the rebuild Iowa infrastructure
  3 20 fund for the fiscal year beginning July 1, 1998 to the
  3 21 departments of corrections and of general services and
  3 22 making statutory changes relating to appropriations."
