1 1 Amend Senate File 2396 as follows:
1 2 #1. Page 1, by striking lines 4 through 12 and
1 3 inserting the following: "procedure that causes an
1 4 abortion, unless such abortion is medically necessary.
1 5 For purposes of this subsection, an abortion is
1 6 medically necessary if it is performed under one of
1 7 the following conditions:
1 8 a. The attending physician certifies that
1 9 continuing the pregnancy would endanger the life of
1 10 the pregnant woman.
1 11 b. The attending physician certifies that the
1 12 fetus is physically deformed, mentally deficient, or
1 13 afflicted with a congenital illness.
1 14 c. The pregnancy is the result of a rape which is
1 15 reported within forty-five days of the incident to a
1 16 law enforcement agency or public or private health
1 17 agency which may include a family physician.
1 18 d. The pregnancy is the result of incest which is
1 19 reported within one hundred fifty days of the incident
1 20 to a law enforcement agency or public or private
1 21 health agency which may include a family physician.
1 22 e. The abortion is a spontaneous abortion,
1 23 commonly known as a miscarriage, wherein not all of
1 24 the products of conception are expelled."
