  1  1    Amend Senate File 2366 as follows:
  1  2    #1.  Page 25, by inserting after line 33 the
  1  3 following:
  1  4    "Sec.    .  NEW SECTION.  297A.1  SCHOOL
  1  5 INFRASTRUCTURE FUND – APPROPRIATION.
  1  6    1.  There is appropriated from the general fund of
  1  7 the state to the department of education for the
  1  8 fiscal year beginning July 1, 1998, and ending June
  1  9 30, 1999, the sum of one hundred million dollars to
  1 10 establish, maintain, and administer a school
  1 11 infrastructure fund.
  1 12    2.  Moneys appropriated in subsection 1 shall be
  1 13 allocated to school districts throughout the state on
  1 14 a per pupil basis.  The amount of moneys allocated to
  1 15 school districts shall be in the proportion that the
  1 16 basic enrollment of a district bears to the sum of the
  1 17 basic enrollments of all school districts in the state
  1 18 for the budget year.
  1 19    3.  The department of management shall allocate to
  1 20 each school district the amount calculated pursuant to
  1 21 subsection 2 in one payment on or about October 15,
  1 22 based upon the actual enrollment certified to the
  1 23 department of education for each school district and
  1 24 forwarded to the department of management, taking into
  1 25 consideration the relative budget and cash position of
  1 26 the state resources.  By October 1, prior to the
  1 27 receipt of funds, school districts shall submit to the
  1 28 department of education a school infrastructure
  1 29 progress report.  The report shall provide adequate
  1 30 assurance that the school district has developed or is
  1 31 developing a school infrastructure plan containing an
  1 32 analysis of school district infrastructure needs,
  1 33 priorities, and an estimated timetable for completion
  1 34 of infrastructure projects or allocation of funds
  1 35 previously received by the school district pursuant to
  1 36 subsection 2.
  1 37    4.  Moneys received under this section shall not be
  1 38 commingled with state aid payments made under section
  1 39 257.16 to a school district, and shall be accounted
  1 40 for by the school district separately from state aid
  1 41 payments.  Payments made to school districts pursuant
  1 42 to this section are miscellaneous income for purposes
  1 43 of chapter 257 or are considered encumbered.  Each
  1 44 school district shall maintain a separate listing
  1 45 within its budget for payments received and
  1 46 expenditures made pursuant to this section.  Moneys
  1 47 received under this section shall not be used for
  1 48 payment of any collective bargaining agreement or
  1 49 arbitrator's decision negotiated or awarded under
  1 50 chapter 20.
  2  1    5.  For purposes of this chapter, a "school
  2  2 district" shall mean a school district as defined in
  2  3 section 257.2.
  2  4    Sec.    .  NEW SECTION.  297A.2  SCHOOL
  2  5 INFRASTRUCTURE EXPENDITURES.
  2  6    1.  School districts shall expend funds received
  2  7 pursuant to section 297A.1 for school infrastructure
  2  8 needs.  For purposes of this chapter, "school
  2  9 infrastructure" includes the following:
  2 10    a.  Activities for which a school district is
  2 11 authorized to contract indebtedness and issue general
  2 12 obligation bonds under section 296.1, except those
  2 13 activities related to a teacher's or superintendent's
  2 14 home or homes.  These activities include the
  2 15 construction, reconstruction, repair, purchasing, or
  2 16 remodeling of schoolhouses, stadiums, gyms,
  2 17 fieldhouses, and bus garages.
  2 18    b.  Procurement of school house construction sites
  2 19 and the making of site improvements.
  2 20    c.  Payment or retirement of outstanding bonds
  2 21 previously issued for school infrastructure purposes,
  2 22 as defined in this subsection, if it is determined by
  2 23 the department of education that the school district
  2 24 has undertaken a serious effort to meet its school
  2 25 infrastructure needs.  In making this determination,
  2 26 the department shall consider the relative size and
  2 27 property tax base of the school district, and the
  2 28 information provided to the department in the school
  2 29 district's infrastructure progress report pursuant to
  2 30 section 297A.1.
  2 31    d.  Maintenance of schoolhouses and school district
  2 32 property.
  2 33    e.  School improvement technology programs pursuant
  2 34 to chapter 295, utilized for a school district.
  2 35    2.  Funds received by a school district pursuant to
  2 36 this chapter shall not be expended to add a full-time
  2 37 equivalent position or otherwise increase staffing."
