The department shall establish a 3 36 steering committee whose voting members shall include 3 37 the director of the department of education, a 3 38 representative from the Iowa association of community 3 39 college trustees, a representative from the Iowa 3 40 association of community college presidents, and two 3 41 persons representing the general public appointed by 3 42 the state board of education. Nonvoting, ex officio 3 43 members of the steering committee shall include a 3 44 representative from the legislative fiscal bureau and 3 45 the legislative service bureau. The steering 3 46 committee shall select a chairperson from among the 3 47 members appointed by the state board of education. 3 48 2. The steering committee shall define the charge 3 49 of the study. However, the study shall include, but 3 50 is not limited to, all of the following: 4 1 a. A review of the existing community college 4 2 governance structure including relationships between 4 3 the community colleges, the Iowa association of 4 4 community college trustees, the Iowa association of 4 5 community college presidents, the state board of 4 6 education, the department of education, local school 4 7 districts, and other postsecondary institutions in 4 8 this state. 4 9 b. An analysis of the strengths and weaknesses of 4 10 the current governance structure. 4 11 c. Proposals for at least three governance 4 12 structures, one of which shall include only minimal, 4 13 but necessary, changes in the current governance 4 14 structure. However, proposals shall be based upon the 4 15 assumption that the board of directors for each 4 16 community college shall remain unchanged due to 4 17 property tax and local representation concerns. Each 4 18 proposal shall include an analysis of the advantages 4 19 and disadvantages of each alternative governance 4 20 structure. 4 21 3. The steering committee shall contract with a 4 22 person to conduct the study of the community college 4 23 governance structure. 4 24 4. The steering committee shall submit its 4 25 findings and recommendations to the general assembly 4 26 by December 31, 1997." 4 27 #20. The general assembly finds and declares 4 50 that the new Iowa schools development corporation was 5 1 designed to be a broad-based coalition of public and 5 2 private educational entities to enhance school 5 3 improvement in this state. 5 4 Sec. ___. LIBRARY COOPERATION PLAN OF ACTION TASK 5 5 FORCE. The department of education shall coordinate a 5 6 library cooperation plan of action task force. The 5 7 task force shall consist of the following members: 5 8 1. The director of an accredited program of 5 9 library science at an institution of higher learning 5 10 under the control of the state board of regents. The 5 11 director shall be the chairperson of the task force. 5 12 2. The director of the department of education or 5 13 the director's designee. 5 14 3. The state librarian. 5 15 4. A member of the state board of regents who 5 16 shall be appointed by the chairperson of the state 5 17 board of regents. 5 18 5. A representative from the Iowa association of 5 19 independent colleges and universities. 5 20 6. A representative from the Iowa hospital 5 21 association. 5 22 7. Three representatives from the Iowa library 5 23 association, one of which shall represent a library 5 24 that serves a population of fifty thousand or more; 5 25 one of which shall represent a library that serves a 5 26 population that is greater than two thousand five 5 27 hundred but less than fifty thousand; and one of which 5 28 shall represent a library that serves a population of 5 29 two thousand five hundred or less. 5 30 8. A librarian employed by a school district who 5 31 shall be appointed by the director of the department 5 32 of education. 5 33 The task force shall design an action plan with the 5 34 intent of promoting cooperation between all libraries, 5 35 public and private, within the state. The task force 5 36 shall utilize information gathered for the 1996 Iowa 5 37 joint use library guide. The task force is encouraged 5 38 to be creative in terms of funding and redesigning the 5 39 current system of public and private libraries, 5 40 including, but not limited to, a study of the 5 41 feasibility of colocating school district libraries 5 42 and public libraries and potential pilot projects. 5 43 Every effort shall be made to develop a plan for 5 44 cooperation at the existing level of state funding for 5 45 libraries. The task force shall also examine library 5 46 cooperation efforts within the state and in other 5 47 states. The task force shall make recommendations to 5 48 the general assembly by December 1, 1997." 5 49 #22. In addition to the funds appropriated 6 25 in section 279.51, subsection 1, there is appropriated 6 26 from the general fund of the state to the department 6 27 of education for the fiscal year beginning July 1, 6 28 1997, and ending June 30, 1998, the amount of $250,000 6 29 to be allocated to the child development coordinating 6 30 council established in chapter 256A for the purposes 6 31 set out in section 279.51, subsection 2, and section 6 32 256A.3. 6 33 Sec. ___. Section 19A.3, subsection 24, unnumbered 6 34 paragraph 2, Code 1997, is amended to read as follows: 6 35 The director of the department of personnel shall 6 36 negotiateagreementsan agreement with the director of 6 37 the department for the blindand with the director of6 38the department of educationconcerning the 6 39 applicability of the merit system to the professional 6 40 employees oftheir respective agenciesthe department 6 41 for the blind. 6 42 Sec. ___. Section 256.10, Code 1997, is amended to 6 43 read as follows: 6 44 256.10 EMPLOYMENT OF PROFESSIONAL STAFF. 6 45 The salary of the director shall be fixed by the 6 46 governor within a range established by the general 6 47 assembly. Appointments to the professional staff of 6 48 the department shall be without reference to political 6 49 party affiliation, religious affiliation, sex, or 6 50 marital status, but shall be based solely upon 7 1 fitness, ability, and proper qualifications for the 7 2 particular position. The professional staff shall 7 3 serve at the discretion of the director. A member of 7 4 the professional staff shall not be dismissed for 7 5 cause withoutat least ninety days' notice, except in7 6cases of conviction of a felony or cases involving7 7moral turpitudeappropriate due process procedures 7 8 including a hearing.In cases of procedure for7 9dismissal, the accused has the same right to notice7 10and hearing as teachers in the public school systems7 11as provided in section 279.27 to the extent that it is7 12applicable." 7 13 #32. Page 21, by inserting before line 19 the 7 14 following: 7 15 "Sec. ___. Section 257B.1A, Code 1997, is amended 7 16 by striking the section and inserting in lieu thereof 7 17 the following: 7 18 257B.1A INTEREST FOR IOWA SCHOOLS FUND TRANSFER 7 19 OF INTEREST. 7 20 1. The interest for Iowa schools fund is 7 21 established in the office of the treasurer of state. 7 22 The department of revenue and finance shall deposit 7 23 interest earned on the permanent school fund in the 7 24 interest for Iowa schools fund. Of the interest 7 25 deposited in the interest for Iowa schools fund each 7 26 year, fifty percent shall be transferred to the first 7 27 in the nation in education foundation as established 7 28 in section 257A.1 and fifty percent shall be 7 29 transferred to the international center for gifted and 7 30 talented education endowment fund established in 7 31 section 263.8A. The department of revenue and finance 7 32 shall transfer interest as provided in this section on 7 33 a quarterly basis. As a condition of receiving funds 7 34 under this section, the foundation and the center 7 35 shall maintain and continue to increase the balances 7 36 of their private foundations. In addition, the 7 37 foundation and the center shall each certify to the 7 38 department of revenue and finance and the general 7 39 assembly, by January 1 of each year, the cumulative 7 40 total value of contributions received during the 7 41 preceding calendar year. 7 42 2. If the general assembly appropriates funds to 7 43 the international center endowment fund in the amount 7 44 of not less than eight hundred seventy-five thousand 7 45 dollars prior to July 1, 1998, the center's interest 7 46 allocation shall decrease to twenty-five percent. If 7 47 the general assembly appropriates funds to the 7 48 international center endowment fund in an amount of 7 49 not less than one million five hundred fifty thousand 7 50 dollars, the center shall no longer receive an 8 1 interest allocation. 8 2 3. The foundation and the center shall use for 8 3 administrative costs not more than twenty-five percent 8 4 of any moneys received annually pursuant to this 8 5 section." 8 6 #33. The State of Iowa pays 8 23 approximately $____ of the average cost for a full- 8 24 time state resident student at this community 8 25 college."" 8 26 #35. By striking page 23, line 34, through page 8 27 25, line 31. 8 28 #36. Page 26, by inserting after line 9 the 8 29 following: 8 30 "Sec. 202. Section 262.9, Code 1997, is amended by 8 31 adding the following new subsection: 8 32 NEW SUBSECTION. 30. Cause to be printed on all 8 33 statements of account for payment of tuition and fees 8 34 issued by each institution of higher learning under 8 35 the control of the board the portion of the average 8 36 cost of an Iowa resident student's education at the 8 37 institution issuing the statement that is paid by 8 38 appropriations from the general fund of the state. 8 39 The information, rounded to the nearest one-tenth of 8 40 one percent and the nearest whole dollar, shall be 8 41 included in the following statement: 8 42 "Tuition pays for approximately ____% of the 8 43 average cost for a resident Iowa student at this 8 44 institution of higher learning. The State of Iowa 8 45 pays approximately $____ of the average cost for a 8 46 full-time state resident student at this institution 8 47 of higher learning."" 8 48 #37. Page 26, by inserting before line 10 the 8 49 following: 8 50 "Sec. . Section 294A.25, subsection 4, Code 9 1 1997, is amended by striking the subsection. 9 2 Sec. . Section 294A.25, Code 1997, is amended 9 3 by adding the following new subsection: 9 4 NEW SUBSECTION. 4A. For the fiscal year beginning 9 5 July 1, 1997, and ending June 30, 1998, the amount of 9 6 fifty thousand dollars to be paid to the department of 9 7 education for participation in a state and national 9 8 project, the national assessment of education 9 9 progress, to determine the academic achievement of 9 10 Iowa students in math, reading, science, United States 9 11 history, or geography." 9 12 #38. Page 26, by striking lines 10 and 11 and 9 13 inserting the following: 9 14 "Sec. . Section 294A.25, subsection 7, Code 9 15 1997, is amended to read as follows:" 9 16 #39. Section 294A.25, subsection 8, Code 9 19 1997, is amended by striking the subsection and 9 20 inserting in lieu thereof the following: 9 21 8. For the fiscal year beginning July 1, 1997, and 9 22 ending June 30, 1998, to the department of education 9 23 from phase III moneys the amount of one million two 9 24 hundred fifty thousand dollars for school 9 25 transformation design and implementation projects. Of 9 26 the funds distributed pursuant to this subsection, up 9 27 to one million two hundred fifty thousand dollars 9 28 shall be transferred to the new Iowa schools 9 29 development corporation if the corporation provides a 9 30 one dollar match for every five dollars of state 9 31 financial assistance. The match may consist of cash 9 32 and in-kind support but shall not consist of receipts 9 33 from local school districts. The corporation shall 9 34 use the state financial assistance to aid local school 9 35 districts for school transformation design and 9 36 implementation projects. The department shall 9 37 distribute funds on a quarterly basis if the 9 38 corporation certifies quarterly to the department the 9 39 in-kind and cash contributions received. However, the 9 40 department shall distribute the first quarter funds on 9 41 July 1, 1997, based upon the corporation's current in- 9 42 kind match. The corporation shall submit an annual 9 43 financial report to the department of education and 9 44 the general assembly by January 1, 1998." 9 45 #40. Page 26, by inserting before line 27 the 9 46 following: 9 47 "Sec. . Section 303.3, subsection 3, Code 1997, 9 48 is amended by striking the subsection and inserting in 9 49 lieu thereof the following: 9 50 3. Notwithstanding section 8.33, moneys committed 10 1 to grantees under this section that remain 10 2 unencumbered or unobligated on June 30 of the fiscal 10 3 year for which the funds were appropriated shall not 10 4 revert but shall be available for expenditure for the 10 5 following fiscal year for the purposes of subsection 10 6 2." 10 7 #41.
