  1  8    #4.  Page 2, by striking lines 40 through 42.
  1  9    #5.  Page 2, lines 43 and 44, by striking the words
  1 10 "report on the progress of the vertical infrastructure
  1 11 survey and".
  1 12    #6.  Page 4, by striking lines 10 through 12 and
  1 13 inserting the following:

  1 33                "DEPARTMENT OF EDUCATION
  1 34    Sec.    .  There is appropriated from the rebuild
  1 35 Iowa infrastructure fund to the department of
  1 36 education for the fiscal year beginning July 1, 1997,
  1 37 and ending June 30, 1998, the following amount, or so
  1 38 much thereof as is available, to be used for the
  1 39 purpose designated:
  1 40    For deposit in the support construction and
  1 41 habilitation of our local schools fund created in
  1 42 section 257D.2:" 
  1 43 .................................................. $ 10,000,000"
  1 44    #13.  Page 16, by inserting after line 28 the
  1 45 following:
  1 46    "Sec.    .  NEW SECTION.  257D.1  TITLE.
  1 47    This chapter may be cited as the "Support
  1 48 Construction and Habilitation of Our Local Schools
  1 49 Act".
  1 50    Sec.    .  NEW SECTION.  257D.2  SUPPORT
  2  1 CONSTRUCTION AND HABILITATION OF OUR LOCAL SCHOOLS
  2  2 FUND.
  2  3    1.  a.  A support construction and habilitation of
  2  4 our local schools (SCHOOLS) fund is created within the
  2  5 state treasury under the control of the department of
  2  6 education.  The SCHOOLS fund shall consist of any
  2  7 moneys appropriated by the general assembly and any
  2  8 other moneys available to and obtained or accepted by
  2  9 the department from the federal government or private
  2 10 sources for placement in the SCHOOLS fund.  The assets
  2 11 of the SCHOOLS fund shall be used by the department as
  2 12 provided in subsection 2.
  2 13    b.  Payments of interest, recaptures of grants, or
  2 14 repayments of moneys granted shall be deposited in the
  2 15 fund.  Section 8.33 does not apply to any moneys in
  2 16 the fund.
  2 17    c.  The fund is subject to an annual audit by the
  2 18 auditor of state.  Moneys in the fund, which may be
  2 19 subject to warrants written by the director of revenue
  2 20 and finance, shall be drawn upon the written
  2 21 requisition of the director of the department of
  2 22 education or an authorized representative of the
  2 23 director.
  2 24    d.  As used in this chapter, "vertical
  2 25 infrastructure" has the same meaning as in section
  2 26 8.57, subsection 5, except that "vertical
  2 27 infrastructure" shall not include recreational trails.
  2 28 A matching grant shall only be awarded for specific
  2 29 vertical infrastructure projects certified to the
  2 30 department in the application.
  2 31    2.  Moneys in the SCHOOLS fund shall be distributed
  2 32 to school districts based on the actual enrollment of
  2 33 students in the district as certified pursuant to
  2 34 section 257.6."
