  1  1    Amend the amendment, S-3744, to House File 733, as
  1  2 amended, passed, and reprinted by the House, as
  1  3 follows:
  1  4    #1.  Page 16, by inserting after line 28 the
  1  5 following:  
  1  6                      "DIVISION    
  1  7             SCHOOL VERTICAL INFRASTRUCTURE
  1  8    Sec.    .  Section 8.22A, subsection 5, paragraph
  1  9 a, Code 1997, is amended to read as follows:
  1 10    a.  The amount of lottery revenues for the
  1 11 following fiscal year to be available for disbursement
  1 12 transferred from the lottery fund to the rebuild Iowa
  1 13 infrastructure fund following the deductions made
  1 14 pursuant to section 99E.10, subsection 1.
  1 15    Sec.    .  Section 99E.10, subsection 1, unnumbered
  1 16 paragraph 3, Code 1997, is amended to read as follows:
  1 17    The committing the lottery to environment,
  1 18 agriculture, and natural resources fund, also to be
  1 19 known as the CLEAN fund, is created in the office of
  1 20 the treasurer of state.  Lottery revenue remaining
  1 21 after expenses are determined shall be transferred to
  1 22 the CLEAN rebuild Iowa infrastructure fund on a
  1 23 monthly basis.  Revenues generated during the last
  1 24 month of the fiscal year which are transferred to the
  1 25 CLEAN rebuild Iowa infrastructure fund during the
  1 26 following fiscal year shall be considered revenues
  1 27 transferred during the previous fiscal year for
  1 28 purposes of the allotments made to and appropriations
  1 29 made from the separate accounts in the CLEAN fund for
  1 30 that previous fiscal year.  However, upon the request
  1 31 of the director and subject to approval by the
  1 32 treasurer of state, an amount sufficient to cover the
  1 33 foreseeable administrative expenses of the lottery for
  1 34 a period of twenty-one days may be retained from the
  1 35 lottery revenue.  Prior to the monthly transfer to the
  1 36 CLEAN rebuild Iowa infrastructure fund, the director
  1 37 may direct that lottery revenue shall be deposited in
  1 38 the lottery fund and in interest-bearing accounts
  1 39 designated by the treasurer of state in the financial
  1 40 institutions of this state or invested in the manner
  1 41 provided in section 12B.10.  Interest or earnings paid
  1 42 on the deposits or investments is considered lottery
  1 43 revenue and shall be transferred to the CLEAN rebuild
  1 44 Iowa infrastructure fund in the same manner as other
  1 45 lottery revenue.  Money in the CLEAN fund shall be
  1 46 deposited in interest-bearing accounts in financial
  1 47 institutions in this state or invested in the manner
  1 48 provided in section 12B.10.  The interest or earnings
  1 49 on the deposits or investments shall be considered
  1 50 part of the CLEAN fund and shall be retained in the
  2  1 fund unless appropriated by the general assembly.
  2  2    Sec.    .  Section 99E.10, subsection 2, Code 1997,
  2  3 is amended to read as follows:
  2  4    2.  The director of management shall not include
  2  5 lottery revenues in the director's fiscal year revenue
  2  6 estimates.  Moneys in the CLEAN fund shall not be
  2  7 considered a part of the Iowa economic emergency fund.
  2  8    Sec.    .  Section 99E.20, subsection 2, Code 1997,
  2  9 is amended to read as follows:
  2 10    2.  A lottery fund is created in the office of the
  2 11 treasurer of state.  The fund consists of all revenues
  2 12 received from the sale of lottery tickets or shares
  2 13 and all other moneys lawfully credited or transferred
  2 14 to the fund.  The commissioner shall certify monthly
  2 15 that portion of the fund that is transferred to the
  2 16 CLEAN rebuild Iowa infrastructure fund under section
  2 17 99E.10 and shall cause that portion to be transferred
  2 18 to the CLEAN rebuild Iowa infrastructure fund of the
  2 19 state.  The commissioner shall certify before the
  2 20 twentieth of each month that portion of the lottery
  2 21 fund resulting from the previous month's sales to be
  2 22 transferred to the CLEAN rebuild Iowa infrastructure
  2 23 fund.
  2 24    Sec.    .  NEW SECTION.  257D.1  TITLE.
  2 25    This chapter may be cited as the "Support
  2 26 Construction and Habilitation of Our Local Schools
  2 27 Act".
  2 28    Sec.    .  NEW SECTION.  257D.2  SUPPORT
  2 29 CONSTRUCTION AND HABILITATION OF OUR LOCAL SCHOOLS
  2 30 FUND.
  2 31    1.  a.  A support construction and habilitation of
  2 32 our local schools (SCHOOLS) fund is created within the
  2 33 state treasury under the control of the department of
  2 34 education.  For the fiscal year beginning July 1,
  2 35 1997, and each subsequent fiscal year there shall be
  2 36 appropriated from the rebuild Iowa infrastructure fund
  2 37 to the SCHOOLS fund all moneys transferred to the
  2 38 rebuild Iowa infrastructure fund pursuant to sections
  2 39 99E.10 and 99E.20.  In addition to moneys appropriated
  2 40 from the rebuild Iowa infrastructure fund, the SCHOOLS
  2 41 fund shall include any other moneys available to and
  2 42 obtained or accepted by the department from the
  2 43 federal government or private sources for placement in
  2 44 the SCHOOLS fund.  The assets of the SCHOOLS fund
  2 45 shall be used by the department as provided in
  2 46 subsection 2.
  2 47    b.  Payments of interest, recaptures of grants, or
  2 48 repayments of moneys granted shall be deposited in the
  2 49 fund.  Section 8.33 does not apply to any moneys in
  2 50 the fund.
  3  1    c.  The fund is subject to an annual audit by the
  3  2 auditor of state.  Moneys in the fund, which may be
  3  3 subject to warrants written by the director of revenue
  3  4 and finance, shall be drawn upon the written
  3  5 requisition of the director of the department of
  3  6 education or an authorized representative of the
  3  7 director.
  3  8    d.  As used in this chapter, "vertical
  3  9 infrastructure" has the same meaning as in section
  3 10 8.57, subsection 5, except that "vertical
  3 11 infrastructure" shall not include recreational trails.
  3 12 A matching grant shall only be awarded for specific
  3 13 vertical infrastructure projects certified to the
  3 14 department in the application.
  3 15    2.  Moneys in the SCHOOLS fund shall be distributed
  3 16 to school districts based on the actual enrollment of
  3 17 students in the district as certified pursuant to
  3 18 section 257.6."
