  1  1    Amend House File 697, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 5, by inserting after line 20 the
  1  4 following:
  1  5    "Sec. ___.  NEW SECTION.  56.14A  FALSE INFORMATION
  1  6 IN POLITICAL MATERIAL.
  1  7    1.  A person shall not be a sponsor of any
  1  8 published material on behalf of or in opposition to
  1  9 any candidate or ballot issue that contains any
  1 10 assertion, representation, or statement of fact,
  1 11 including, but not limited to, information concerning
  1 12 a candidate's prior public record, which the sponsor
  1 13 knows to be untrue, deceptive, or misleading.
  1 14    2.  For purposes of this section, "published
  1 15 material" means statements or graphic representations
  1 16 made through any public medium which includes, but is
  1 17 not limited to, any of the following:
  1 18    a.  Electronic media such as live or prerecorded
  1 19 radio or television broadcasts, broadcasts or
  1 20 transmissions through other publicly available
  1 21 electronic communications, and video or audio tape
  1 22 recordings which are publicly distributed.
  1 23    b.  Print media, such as newspapers, pamphlets,
  1 24 folders, display cards, signs, posters, or billboard
  1 25 advertisements.
  1 26    c.  Any other methods or mediums designed for
  1 27 publicly advertising or publishing information.
  1 28    3.  For purposes of this section, "sponsor" means a
  1 29 person who pays for or approves published material and
  1 30 shall include a candidate or committee which knows and
  1 31 approves of an independent expenditure made by another
  1 32 person under section 56.13."
