  1  1    Amend House File 697, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 6, by inserting before line 20 the
  1  4 following:
  1  5    "Sec.    .  Section 68B.32, subsection 1, Code
  1  6 1997, is amended to read as follows:
  1  7    1.  An Iowa ethics and campaign disclosure board is
  1  8 established as an independent agency.  Effective
  1  9 January 1, 1994, the board shall administer this
  1 10 chapter and set standards for, investigate complaints
  1 11 relating to, and monitor the ethics of officials,
  1 12 employees, lobbyists, and candidates for office in the
  1 13 executive branch of state government, and candidates
  1 14 for office in the general assembly.  The board shall
  1 15 also administer and set standards for, investigate
  1 16 complaints relating to, and monitor the campaign
  1 17 finance practices of candidates for public office.
  1 18 The board shall consist of six members and shall be
  1 19 balanced as to political affiliation as provided in
  1 20 section 69.16.  The members shall be appointed by the
  1 21 governor, subject to confirmation by the senate."
  1 22    #2.  Page 7, by inserting before line 11 the
  1 23 following:
  1 24    "Sec.    .  Section 68B.32A, subsection 12, Code
  1 25 1997, is amended to read as follows:
  1 26    12.  Establish rules relating to ethical conduct
  1 27 for persons holding a state office in the executive
  1 28 branch of state government, including candidates, and
  1 29 for employees of the executive branch of state
  1 30 government, and for candidates for any state office.
  1 31 The board shall also establish regulations governing
  1 32 the conduct of lobbyists of the executive branch of
  1 33 state government, including.  The rules which
  1 34 regulations shall include, but are not limited to,
  1 35 rules and regulations governing conflicts of interest,
  1 36 abuse of office or position, misuse of public or
  1 37 campaign property, campaign advertising, use of
  1 38 confidential information, participation in matters in
  1 39 which an official or state employee has a financial
  1 40 interest, and rejection of improper offers.
  1 41    Sec.    .  Section 68B.32B, subsection 1, Code
  1 42 1997, is amended to read as follows:
  1 43    1.  Any person may file a complaint alleging that a
  1 44 candidate, committee, person holding a state office in
  1 45 the executive branch of state government, employee of
  1 46 the executive branch of state government, or other
  1 47 person has committed a violation of chapter 56 or
  1 48 rules adopted by the board.  Any person may file a
  1 49 complaint alleging that a person holding a state
  1 50 office in the executive branch of state government, an
  2  1 employee of the executive branch of state government,
  2  2 a candidate for state office, or a lobbyist or a
  2  3 client of a lobbyist of the executive branch of state
  2  4 government has committed a violation of this chapter
  2  5 or rules adopted by the board.  The board shall
  2  6 prescribe and provide forms for this purpose.  A
  2  7 complaint must include the name and address of the
  2  8 complainant, a statement of the facts believed to be
  2  9 true that form the basis of the complaint, including
  2 10 the sources of information and approximate dates of
  2 11 the acts alleged, and a certification by the
  2 12 complainant under penalty of perjury that the facts
  2 13 stated to be true are true to the best of the
  2 14 complainant's knowledge."
