1 3 #1. By striking page 1, line 29, through page 2,
1 4 line 1, and inserting the following:
1 5 "3. If a political subdivision finds that a new
1 6 activity, new service, or increase in service is
1 7 required by law or rule and sufficient moneys are not
1 8 appropriated to fully fund the activity or service as
1 9 provided in subsection 1, the political subdivision
1 10 shall carry out the new activity or service or shall
1 11 apply to the district court of the district in which
1 12 the political subdivision is located, to determine
1 13 whether or not the new activity, new service, or
1 14 increase in service is a state mandate and, if a state
1 15 mandate exists, whether or not sufficient moneys have
1 16 been appropriated by the state to fully fund the state
1 17 mandate. If the district court finds that a state
1 18 mandate is not imposed or that a state mandate is
1 19 imposed without sufficient moneys appropriated to
1 20 fully fund the state mandate, a political subdivision
1 21 affected by the state mandate is not required to carry
1 22 the state mandate."
