1 1 Amend Senate File 529 as follows:
1 2 #1. Page 21, by inserting after line 34 the
1 3 following:
1 4 "Sec. . Section 99D.9, Code 1997, is amended by
1 5 adding the following new subsection:
1 6 NEW SUBSECTION. 6A. A licensee or an agent of a
1 7 licensee shall not establish or operate a family or
1 8 group day care home or center in violation of section
1 9 237A.30.
1 10 Sec. . Section 99F.7, subsection 5, paragraph
1 11 b, Code 1997, is amended by striking the paragraph.
1 12 Sec. . Section 99F.7, Code 1997, is amended by
1 13 adding the following new subsection:
1 14 NEW SUBSECTION. 14A. A licensee or an agent of a
1 15 licensee shall not establish or operate a family or
1 16 group day care home or center in violation of section
1 17 237A.30.
1 18 Sec. . NEW SECTION. 237A.30 GAMBLING
1 19 ESTABLISHMENTS.
1 20 1. For the purposes of this section, unless the
1 21 context otherwise requires, "gambling establishment"
1 22 means any structure, building, or other facility which
1 23 is owned, leased, rented, or otherwise operated, used,
1 24 or controlled by any of the following:
1 25 a. A person licensed under chapter 99D to operate
1 26 a pari-mutuel racetrack.
1 27 b. A person licensed under chapter 99F to operate
1 28 an excursion gambling boat or gambling games at a
1 29 pari-mutuel racetrack enclosure.
1 30 2. Child day care may be provided in accordance
1 31 with this chapter in a gambling establishment if the
1 32 care is available only to the children of persons
1 33 employed by the gambling establishment or if the child
1 34 day care has been authorized to be provided in a
1 35 gambling establishment pursuant to an agreement
1 36 entered into or exception to policy issued by the
1 37 director of human services or the department of human
1 38 services which is in existence as of the effective
1 39 date of this Act.
1 40 3. Except for child day care provided in
1 41 accordance with subsection 2, a family or group day
1 42 care home or center shall not be established or
1 43 operated in or by a gambling establishment.
1 44 Establishing or operating a family or group day care
1 45 home or center in violation of this section is subject
1 46 to penalty under section 237A.19 and injunction under
1 47 section 237A.20."
