  1  1    Amend Senate File 533 as follows:
  1  2    #1.  Page 31, by inserting after line 35 the
  1  3 following:
  1  4    "Sec. ___.  Section 904.706, unnumbered paragraph
  1  5 1, Code 1997, is amended to read as follows:
  1  6    A revolving farm fund is created in the state
  1  7 treasury in which the department shall deposit
  1  8 receipts from agricultural products, nursery stock,
  1  9 agricultural land rentals, and the sale of livestock.
  1 10 However, before any agricultural operation is phased
  1 11 out, the department which proposes to discontinue this
  1 12 operation shall notify the governor, chairpersons and
  1 13 ranking members of the house and senate appropriations
  1 14 committees, and cochairpersons and ranking members of
  1 15 the subcommittee in the senate and house of
  1 16 representatives which has handled the appropriation
  1 17 for this department in the past session of the general
  1 18 assembly.  Before the department sells farmland under
  1 19 the control of the department, the director shall
  1 20 notify the governor, chairpersons and ranking members
  1 21 of the house and senate appropriations committees, and
  1 22 cochairpersons and ranking members of the joint
  1 23 appropriations subcommittee that handled the
  1 24 appropriation for the department during the past
  1 25 session of the general assembly.  The department shall
  1 26 not phase out or discontinue any agricultural
  1 27 operation or sell any farmland under the control of
  1 28 the department that existed as of January 1, 1997.  In
  1 29 addition, no sale or discontinuance of operations
  1 30 shall cause the level of activity or inmate
  1 31 participation to fall below the level of activity or
  1 32 participation which was in effect on January 1, 1997.
  1 33 The department may pay from the fund for the
  1 34 operation, maintenance, and improvement of farms and
  1 35 agricultural or nursery property under the control of
  1 36 the department.  A purchase order for five thousand
  1 37 dollars or less payable from the fund is exempt from
  1 38 the general purchasing requirements of chapter 18.
  1 39 Notwithstanding section 8.33, unencumbered or
  1 40 unobligated receipts in the revolving farm fund at the
  1 41 end of a fiscal year shall not revert to the general
  1 42 fund of the state."
