PAG LIN 1 1 Amend Senate File 503, as follows: 1 2 #1. Page 1, by inserting after line 19 the 1 3 following: 1 4 "___. A county attorney, or a county attorney's 1 5 designee, upon the filing of an indictment or 1 6 information alleging that the person has unlawfully 1 7 manufactured methamphetamine, its salts, isomers, and 1 8 salts of its isomers in the presence of a minor, shall 1 9 file a petition under section 232.87 alleging that the 1 10 minor is a child in need of assistance. 1 11 Sec. ___. Section 232.69, Code 1997, is amended by 1 12 adding the following new subsection: 1 13 NEW SUBSECTION. 4. In addition to any other 1 14 training required by law, a social worker employed by 1 15 a public or private agency or institution whose duties 1 16 include providing services to children who have been 1 17 exposed to or are addicted to methamphetamine or other 1 18 controlled substances, shall receive specialized 1 19 training on the issue of substance abuse, addiction, 1 20 and environmental evidence of substance abuse and 1 21 addiction in children. 1 22 Sec. ___. Section 232.98, subsection 1, unnumbered 1 23 paragraph 1, Code 1997, is amended to read as follows: 1 24 Except as provided in section 232.78, subsection 4, 1 25 a physical or mental examination of the child may be 1 26 ordered only after the filing of a petition pursuant 1 27 to section 232.87 and after a hearing to determine 1 28 whether an examination is necessary to determine the 1 29 child's physical or mental condition. The court may 1 30 consider chemical dependency as either a physical or 1 31 mental condition and may consider a chemical 1 32 dependency evaluation as either a physical or mental 1 33 examination. If the petition concerns a child who was 1 34 present at the time of or at a location at which 1 35 methamphetamine, its salts, isomers, and salts of its 1 36 isomers, was being unlawfully manufactured, an 1 37 examination of the child, including testing of hair 1 38 samples and an assessment of any physiological damage 1 39 which may have resulted from exposure to the chemical 1 40 substances used or produced in the manufacturing 1 41 process, shall be conducted." 1 42 #2.
