  1  1    Amend Senate File 503 as follows:
  1  2    #1.  Page 1, by inserting after line 25 the
  1  3 following:
  1  4    "Sec.    .  Section 669.2, subsection 4, unnumbered
  1  5 paragraph 1, Code 1997, is amended to read as follows:
  1  6    "Employee of the state" includes any one or more
  1  7 officers, agents, or employees of the state or any
  1  8 state agency, including members of the general
  1  9 assembly, and persons acting on behalf of the state or
  1 10 any state agency in any official capacity, temporarily
  1 11 or permanently in the service of the state of Iowa,
  1 12 whether with or without compensation, but does not
  1 13 include a contractor doing business with the state.
  1 14 Professional personnel, including physicians,
  1 15 osteopathic physicians and surgeons, osteopathic
  1 16 physicians, optometrists, dentists, nurses, physician
  1 17 assistants, and other medical personnel, who render
  1 18 services to patients or inmates of state institutions
  1 19 under the jurisdiction of the department of human
  1 20 services, and employees of the commission of veterans
  1 21 affairs, or the Iowa department of corrections are to
  1 22 be considered employees of the state, whether the
  1 23 personnel are employed on a full-time basis or render
  1 24 services on a part-time basis on a fee schedule or
  1 25 other arrangement.  Criminal defendants while
  1 26 performing unpaid community service ordered by the
  1 27 district court, board of parole, or judicial district
  1 28 department of correctional services, or an inmate
  1 29 inmates providing services pursuant to a chapter 28E
  1 30 an agreement entered into pursuant to section 904.703,
  1 31 and persons providing supervision, security, or
  1 32 transportation for inmates or criminal defendants who
  1 33 are providing the services, are to be considered
  1 34 employees of the state."
  1 35    #2.  Page 7, by inserting after line 15 the
  1 36 following:
  1 37    "Sec.    .  Section 904.703, unnumbered paragraph
  1 38 1, Code 1997, is amended to read as follows:
  1 39    Inmates shall work on state account in the
  1 40 maintenance of state institutions, in the erection,
  1 41 repair, authorized demolition, or operation of
  1 42 buildings and works used in connection with the
  1 43 institutions, and in industries established and
  1 44 maintained in connection with the institutions by the
  1 45 director.  The director shall encourage the making of
  1 46 agreements, including agreements under chapter 28E,
  1 47 with departments and agencies of the state or its
  1 48 political subdivisions to provide products or services
  1 49 under an inmate work program to the departments and,
  1 50 agencies, and political subdivisions.  The director
  2  1 may implement an inmate work program for trustworthy
  2  2 inmates of state correctional institutions, under
  2  3 proper supervision, whether at work centers located
  2  4 outside the state correctional institutions or in
  2  5 construction or maintenance work at public or
  2  6 charitable facilities and for other agencies of state,
  2  7 county, or local government.  The supervision,
  2  8 security, and transportation of, and allowances paid
  2  9 to inmates used in public service projects shall be
  2 10 provided pursuant to agreements made by the director
  2 11 and the agency for which the work is done.  Housing
  2 12 and maintenance shall also be provided pursuant to the
  2 13 agreement unless the inmate is housed and maintained
  2 14 in the correctional facility.  All such work,
  2 15 including but not limited to that provided in this
  2 16 section, shall have as its primary purpose the
  2 17 development of attitudes, skills, and habit patterns
  2 18 which are conducive to inmate rehabilitation.  The
  2 19 director may adopt rules allowing inmates
  2 20 participating in an inmate work program to receive
  2 21 educational or vocational training outside the state
  2 22 correctional institutions and away from the work
  2 23 centers or public or charitable facilities used under
  2 24 a program.
  2 25    Sec.    .  Section 904.703, unnumbered paragraph 3,
  2 26 Code 1997, is amended by striking the paragraph."
  2 27    #3.  Title page, line 13, by inserting after the
  2 28 word "district," the following:  "making changes
  2 29 related to work programs for inmates and criminal
  2 30 defendants,".
