Page 2, line 32, by inserting after the word 1 14 "make" the following: "a reasonable effort to 1 15 identify a person over the age of eighteen but under 1 16 legal age who is discovered to be in possession of 1 17 alcoholic liquor, wine, or beer in violation of 1 18 section 123.47, and the law enforcement agency of 1 19 which the peace officer is an employee shall make a 1 20 reasonable attempt to notify the person's custodial 1 21 parent or legal guardian of the possession, whether or 1 22 not the person is arrested or a citation is issued, 1 23 unless the officer has reasonable grounds to believe 1 24 that the notification is not in the best interest of 1 25 the person or will endanger the person. 1 26 2. A licensee and permittee structured fines pilot 1 38 project is established in the fifth judicial district 1 39 for purposes of assessing appropriate fines for 1 40 licensees and permittees who do either of the 1 41 following: 1 42 a. Sell, give, or otherwise supply alcoholic 1 43 beverages, wine, or beer to any person while knowing, 1 44 or failing to exercise reasonable care to ascertain 1 45 whether, the person is under legal age. 1 46 b. Permit any person to consume any alcoholic 1 47 beverage, wine, or beer while knowing, or failing to 1 48 exercise reasonable care to ascertain whether, the 1 49 person is under legal age. 1 50 2. The chief judge of the fifth judicial district, 2 1 in consultation with the county attorneys of the 2 2 counties located within the judicial district, local 2 3 public defender, representatives of the private 2 4 defense bar, the court administrator, the director of 2 5 pretrial services, the director of the judicial 2 6 district department of correctional services, and 2 7 members of the boards of supervisors of the counties 2 8 located within the judicial district, shall establish 2 9 a structured fine program which takes into 2 10 consideration the facts underlying the offense, the 2 11 age of the person to whom the alcoholic beverage, 2 12 wine, or beer was sold, given, or supplied, any harm 2 13 caused by the commission of the offense, the ability 2 14 of the offender to pay a fine, and the likelihood that 2 15 the offender will commit the offense again. Fines 2 16 assessed shall be within the parameters established 2 17 for fines applicable to serious misdemeanor violations 2 18 under section 903.1." 2 19 #10.
